the way i see it, is legally you have recieved a faulty product, its just your luck that it is cracked because you are entitled to a refund. take the product back, get your refund and don't deal with them again. then when you get your money back you can purchase a set from a reputable dealer....

if you have any problems getting your money back take it to fair trading.

legally speaking. I remain indifferent to any companies mentioned!

    You are refering to...

'Fit for purpose' - See Trade Practices Act

A good must be fit for the purpose its sold under. Ie if something is marketed with a particular function in mind and can't perform that function due to its insufficient quality then its a breach of the TPA all you have to do to prove this is supply it to some impartial people with relevant experience and ask the question will it do the job it was sold to do?

I have a UAS Greedy front bar waiting to go on, was bought many years ago (5 at a guess) no mention of manufactured on it but seems to be of good quality unlike this so called 'bok choi' gear you recently received.

Ive never dealt with them personally but from what ive read and seen i personally wouldnt want to be getting crap products like that.

Plus i would love to be Tiger Woods but he is one ugly black guy lol

Knowing the reputation of CarMate products, I would be very reluctant to purchase anything from them, however, it is not unusual for vendors to have items manufactured by outside companies.
Surely no-one on here believes that every vendor personally manufactures each and every item they offer for sale.
If this item is in any way substandard or damaged, then of course it must be replaced at no additional cost to the purchaser.
What was the outcome when you spoke to UAS about this issue?

I know what my outcome was, "It wasn't us", I wouldn't EVER go back to them or EVER recommend them to ANYONE after my experience with them, car went bang after a stuffed up boost controller install enough said.

How is this in any way related to the topic of this thread?
The difference in this case is that the original Poster actually PAID for the items in contention(unlike some other people)and is obviously entitled to a refund or replacement.

I don't think it's against the law to resell goods for a mark-up. If so, start hating on every other trader on the forum.
I Believe the product is 'fit for purpose' as per TPA.
As Chili said, large manufacturers can be contracted to make products for smaller operations such as UAS in bulk lots or as needed to meet demand (this is smart business). This still might be the case here.
I'm not getting into the packaging side of things- not my position to comment or my problem.

The ethical problems in business arise when you sell something as your own, which is a blatant knock-off of a proprietary product, or are not transparent as to its origin. Looking at the website, it doesn't mention that they are built in-house or are a proprietary UAS design... does it?

If its fit for its purpose, then under section 54 of the ACL 'Guarantee as to acceptable quality' its fails to satisfy sub-section
'(2) Goods are of acceptable quality if they are as:
    (b) acceptable in appearance and finish; and
    (c) free from defects;'

it then goes on to section 3
'(3) The matters for the purposes of subsection (2) are:
    (c) any statements made about the goods on any packaging or label on the goods
    (d) any representation made about the goods by the supplier or manufacturer of the goods'

which appears to have also been breached had he believed he was purchasing a genuine bomex bar and skirts.....

    :)

    Solution-

    1. find out where the owner lives.
    2. Burn his house to the ground.
    3. Drive into sunset with his wife.
