Police harassment

    Can anyone tell me how long do they have befor they can no longer issue with a summons after an offence i.e. with speeding fines If you don't get time with in I think it's a year they cant charge you or is there no expiry date on summons?

    Running a orange light in WA is a $150 fine and 3 points.

    That's a bit doughy if they cant prove ur speed
    Take it to court and get ur mate to come in and testify that they you weren't speeding and that the cops had know way to tell if you were speeding or not. I would be surprised if they make that one stick

    Yeah i read it in the legislation somewhere.... i'll see if i can find it. My mate got done for going through a yellow and thats what he got.

    It's doubtful...

    ...that you'll even get a summons in the mail.
    Cops say this all the time and don't send a summons.

    What I hate is getting flashed by a multinova then getting the fine like 6 months later. Just got one in the mail from July last year. I remember getting flashed and thinking I'll have to make sure the fine says the right amount of km's over but I can't remember how fast I was going all this time later. There has to be a way to complain about this. Not even to get off the fine, just to tell the police this type of service just isn't acceptable.

    im not talking about this time i was talking about when i got pulled up for speeding 2 weeks ago :p and they said i was going to get a summons but one of the guys at work was saying that because the courts a so busy they can get people in in time

    Why do they send a summons ever? I've been pulled up twice I think for speeding. Both ties got an on the spot ticket. Why would they summon you to court for?

    yea but who are you going to tell?. The cops :confused:
    this is the problem I have and people I know have complained about some cops but because of who they are I have never herd anything back saying that they actually did something about it as I don?t think they do

    Because I was going 2 fast its not a speeding fine, if it was i wouldn't care but its for reckless driving witch sucks ass

    ROAD TRAFFIC CODE 2000 - REG 41
    Stopping for a circular yellow signal or yellow arrow

    (1) If a traffic-control signal facing a driver displays a steady circular yellow signal or a yellow arrow, the driver shall not proceed beyond the stop line associated with the signal or the stop line of the lane associated with the signal or in the absence of a stop line, at a point adjacent to the nearest appropriate traffic-control signal, unless the driver is so close to the stop line, or traffic-control signal, when the circular yellow signal or yellow arrow first appears, that the driver cannot safely stop the vehicle before passing over the stop line.

    Points: 2 Modified penalty: 2 PU

    (2) If a traffic-control signal facing a driver displays a steady circular yellow signal or a yellow arrow and the driver cannot safely stop the vehicle in accordance with subregulation (1), but can stop safely before entering the intersection, the driver shall stop before entering the intersection.

    Points: 2 Modified penalty: 2 PU

    (3) If a traffic-control signal facing a driver displays a steady circular yellow signal or a yellow arrow and the driver is not able to stop safely under subregulation (1) or (2), and enters the intersection, the driver shall leave the intersection as soon as the driver can do so safely.

    Points: 2 Modified penalty: 2 PU

    I believe this has been increased to 3 Points and 3 PU - Penalty Unit

    Ok so basically they would have to prove that I had sufficient time to stop when they were ad lest 100m behind me but it is still there word agents mine and if they wanted to be dicks they could get me

    The cop even said I ran the yellow as I didn?t have time to stop but then flowed that statement up with ?because you were speeding? so it wasn?t a win win situation

    Are you the guy who crossed into the opposite lane on the way to Scott's tech day and forced the 4wd into the gravel? Sounds to me like you should be off the road.

    Hehe, then tell him to write you a ticket for speeding, as he just said you didn't have time to stop. Depends on which fine is less. He can't give you a fine for speeding and a fine for not stopping safely, that's just stupid.

    It's like when you watch football and a guy gets tackled from behind. Umpire calls push in back, player says, I had him around the shoulders. Umpire says, fine high tackle. Can't get pinged for both.

    Just because he went on the gravel doesn?t mean that we were that close I had plenty of time to get back in he was just a little spooked by it. You may think im a bad driver but I very rarely go over the limit unless I am trying to keep up with people on cruises as most go to fast but yes it was very stupid of me for speeding when they pinged me. it was late at night and I just gave it a small blast in 3ed gear as I hadn't done it in ages and I thought it would be a good chance to see what my new brakes felt like as the car squirmed quite badly with the old ones (brakes really well with the new ones but feels strange when the slots bite in to the pad) so I was on the go button for no more than 5 seconds (after slowing a little for some lights on leach highway) and then was hard on the brakes but even that was enough to get me court

    I'm terribly sorry to hear such a sad thing happen to such a great person. This sort of thing makes me sad and angry. I hope some sort of justice comes out of this.

    Just a shitty cop having a bad day, i can see how it would piss you off but i wouldnt worry too much man, if you werent doign anything wrong then you got nothing to be afraid of, dont back down
