    A penalty unit in NSW is...

    defined in section 17 of the Crimes (Sentencing Procedure) Act 1999

    'Unless the contrary intention appears, a reference in any Act or statutory rule to a number of penalty units (whether fractional or whole) is taken to be a reference to an amount of money equal to the amount obtained by multiplying $110 by that number of penalty units.'

    In other words, a penalty unit is a $110 :LOL:

    The answer...

    I ran it through one of the guys and this is what he said (the short answer):

    '... taped conversations may very well be admissable if the party complaining is a party to the conversation. Thus it will not be illegal. Check the Act (Evidence Act) to find the relevant section, but it seems the guys tape will be admissable.'

    The long answer:

    Sections 92 and 93 of the Evidence Act is relevant here. They describe the 'admissibility of documentary evidence as to facts in issue' and 'admissibility of documentary evidence as to facts in issue in criminal proceedings'.

    The thing to note here is that in the definition of document which is in schedule 3 of the act that includes:

    'any disc, tape, sound track or other device in which sounds or other data (not being visual images) are embodied so as to be capable (with or without the aid of some other equipment) of being reproduced therefrom...'

    I would venture to say that if you do this, it would be helpful to ask him/her his name, rank and station (which is legal to do) - that would help identify them on the tape.

    In law school you get taught never to go into technicalities with clients but I think if people are interested it's always good to know the details - especially since 'ignorance is no excuse' :thumbsup:

    NSW vehicle number plate requirements

    there was a post elsewhere from a guy in QLD which listed the requirments in the QLD reg for vunbereplate size, visability etc.

    I am new to NSW and cannot find the relevant sectiond in the NSW legislation - any pointers as which piece of legislation and perhaps a section number ?

    Number Plates in NSW :)

    Short answer:
    Have a look here about the placement of number plates. Basically for NSW it's all listed there, the exact requirements. You are looking at the Road Transport (Vehicle Registration) Regulation at section 24.

    Long answer:
    For things like this... The government gives the power to their agencies to make regulations with regards to certain matters (otherwise called delegated legislation). In this instance, the state government has delegated the power to regulate with regards to vehicle registration.

    If you are ever after details to a certain issue and can't find them in a general act, see if there are regulations that go with it. These can be found at Austlii for the Commonwealth and each state.

    You're right Lou...

    I forgot to mention though, check out state and Commonwealth governemnt websites (www.nsw.gov.au, www.qld.gov.au etc) and go into the legislation sections there.

    The problem with Austlii is that it is not always up to date but the government websites almost always are.
