    Everyone in this forum is so friendly and helpful so I thought I could try and do something back for everyone here :)

    I am in my penultimate year at law school. Me and a few other students do volunteer work for various projects and organisations. We have a good support structure consisting of lecturers and solicitors. It won't be a problem to get information for you in pretty much any area of law at all.

    So if any of you guys need any preliminary information or advice on where to go or what to do with regards to any legal stuff (speeding fines... whatever...), email me or sms/call me 0410 584 404.

    I realise everyone is really legally aware these days but hey, if you ever need to find out about something... :)

    Am going to need as much legal advise as i can get come september 29th.


    Alleged speeding offence 135 in a 110 Zone that i know i wasn't doing.

    Should i PM you with details.

    Any suggestions you can give would be greatly appreciated.

    Include all the details - where, when etc

    If it was a patrol car that made the allegation, what's the conversation you had with the officer? Whereabouts did he start noticing that you were 'speeding'? Etc etc...

    Hopefully I can be of some help :)

    When is the fine due?

    Do you know of any websites?

    Sites that provide info on our rights regarding traffic laws?

    For example, I was once told it is within your right to refuse answering any questions other than your full name and the address at which you live. Is this true?

    I thought you didn't have to say anything - you are exercising your right

    to not speak. If they ask for your license, just hand it over and if they ask anymore questions you can say "I am excersing my civil rights to remain silent" but I'm sure they will find a way to right out a ticket with that sort of attitude.

    You just have to look for it.

    No doubt there's probably a more user-friendly site somewhere...

    Some answers :)

    That's right there is a right to silence which has been given statutory effect in state and commonwealth jurisdictions. You can hand over your license and tell them who you are. If it's something pretty serious you can call a friend or a lawyer too.

    I have had experience in situations where answers to simple questions (seemingly innocent) have been used against people as evidence. Normally police record what you say even when they come up to your car on foot.

    You have to be careful here though because if you refuse to say anything, and the officer is in a bad mood, he might decide to comb through your modded car and find faults with it... They have fairly broad powers when it comes to cars.

    As Lou has said, most of the law can be found through Austlii. It's also a good idea to have a look at the state parliament website where they also have legislation (see below). The only thing is you have to know the act or the name of the legislation you're looking for.

    Good information for each state:

    Queensland
    For traffic information have a look at the TORUM - Transport Operations (Road Use Management) Act which can be found here.

    Also have a look at Queensland Transport and the Office of Queensland Parliamentary Counsel.

    New South Wales
    For traffic information have a look at Road Transport (Safety and Traffic Management) Act.

    Also have a look at Roads and Traffic Authority and NSW Parliamentary Counsel's Office.

    Victoria
    For traffic information have a look at the Road Safety Act and also the Road Safety Act.

    Also have a look at Victoria Online's traffic section, LegalOnline and Victorian Legislation and Parliamentary Documents.

    Sorry all you guys from the other states :) If you're after the info I can post it but it's pretty easy info to find.

    I hope this stuff is useful! Sorry for the rambling...

    Would a voice recording I take of myself and the ticket issuing

    officer stand up in court as evidence if I choose to contest it? I have been told only video + audio can be used as evidence in this case and not just digital recorded audio.

    Whats the value of a penalty unit these days? As referred to in the NSW Road Transport (STM) Act.
