    No 'innocent until prooven guilty'

    anymore? If they are going to charge you with speeding, should the onus not be on them to proove your guilt. Not for you to proove your innocence (as that assumes you are guilty until prooven innocent).

    Otherwise we could have police all over the place booking people for no reason to fill their quota for the month (oh wait, it looks like thats whats already happening) :rolleyes: :rolleyes:

    I agree, ALWAYS be nice and courteous to the police, no matter how much of a prick they are being. They have the badge, the gun and the tickets to dish out and chances are you are being recorded on tape.

    I have had a few run ins with the police, most are neutral, 1 was really cool and 1 was a total jerk.

    And also keep in mind, they are mostly undermanned, under resourced and under paid and sometimes have to deal with the scum of the Earth. On the whole, be glad we do have them. You will always get wankers in every and any profession so its nothing new.

    Well, I understand your intent, and by and large it may be true but my story from October will vouch for the fact that minding ones own business, and driving within the law (behaving ones self) doesn't necessarily cut the mustard, although I will admit, that it is a little hard to "Blend" with my Zed.

    I am happy to be nice ( as I am sure Constable Mick Little would attest), as long as I am treated with the respect I deserve as a law abiding citizen.
    Treat me like I'm am asshole, and you won't be disappointed!

    I'm not sure about if they use a radar, but I think they can tail you for x meters and then use their own speed reading to fine you (as it will match yours). At least that's what was explained to me by a cop here in WA once.

    I think you'll find a DUI is when your over 0.8 (I think that's the number), while over 0.5 is drink driving. Different charges. You can't be charged anything for being under 0.5. At best they could give you a reckless driving if you were. But if you were driving normally you have every right to keep going.

    Anyone know what they can do if they suspect your on drugs? Can they take you down the station for a test if you aren't doing anything wrong? Let's say you were eve acting normally but they decided to cause trouble? Not that i do drugs, just wondering.

    The above could be wrong, but that's the law as has been explained to me by cops over the years. Hopefully they weren't wrong. And this was WA.

    for being under 0.5(if your still alive). Under 0.05 is a different thing ;)

    In NSW there are 2 different laws,

    DUI - driving under the influnce, off any drug , medecation , alochol and can be used to charge you at car accidents if they think your pot or pills caused you to be at fault

    PCA - perscribed concentration off alochol , this is where your limit are set for your licence grade

    if you are being charged be sure to know under which law,
    also you can be booked for speeding under the posted limit if the officer considers the conditions are unfavable such as heavy fog, rain , snow .

    That is correct... You can request it.. But they dont have to show you, or they just say that it has been reset..

    In NSW the guns are fixed in the car, no copper is going to allow you to get into the car to have a look..

    This is also correct, but it is an offence to drive drunk... Some people can be under the limit but be drunk.. Havent you seen people pissed after 2 beers.. Thats why that clause exists.. Think about it...

    I dont make the rules, I would suggest if you dont agree, read the crimes act for yourself..

    One another note.. With Penalty Notices, which is what a fine is.. Im sorry to say it is Guilty until Proven Innocent.. Thats how they can be issued on the spot..

    there is car mounted radars only on highway cars and then u have the hand held lidar usually run by motorbike cops. and cars without either of these can still give you a ticket ie they follow you for a set distance maintaining distance and speed. DUI is only for drugs.

    Well if the poor barsteds are mostly undermanned, under resourced and under paid and sometimes have to deal with the scum of the Earth they can do what we get told at work; "if you don't like it, get out and get another job!" In my opinion they are just one step removed from politicians and I consider them lower than a snakes arsehole!

    That was My freakin point.. you dont need to get caught by a radar to be done for speeding...

    Quote myself - "there is a method that is used based on time over distance to calculate an estimated speed... If they believe that you are speeding you can be fined... "

    and you call me a noob... Read the post properly..

    DUI is alcahol, it has only recently been applied to drugs, DUI has been around for 20 or so years ......

    i dont know exactly what powers the police have when they believe you are driving under the influence of drugs, but whatever you do, DO NOT admit anything.

    a 'friend' told me a story about an incident that occurred like this a few years back in perth. not admitting to anything resulted in being held at a booze bus for about 40 mins, breathalised (for alcohol) and released back into the wild.. pretty bizarre considering the state he was in.

    for obvious reasons i dont want to go into the specifics here abtou that.. but golden rule is dont admit to anything and whatever you do dont get smart with them..

    also with drug driving laws they vary from state to state, and it has changed recently especially in victoria with the police having drug testing kits. victoria is extremely draconian and these days they have specific tests for amphetamines (including ecstasy) and cannabis. there's been a lot of advertising about how booze buses are going to start testing for both.

    The big issue a lot of people have with that drugs are present in your system for quite a while. I don't remember the stats on it but they can still detect traces of certain drugs a day or 2 after you ingested them. so its a very real possibility that you could be busted for driving on a monday afternoon after having a big night on saturday. The government justifies the fact that this is a pathetic measure of driving ability by saying 'well people shouldnt do drugs'..

    As for WA, i think they have some semblance of sanity and have not given the green light for drug testing as yet, but it may be on the cards for the future

    And they'd be the first people you call if some scum of the Earth was trying to flog your car off, beat the s#!t out of you or your family or break into your house etc.

    Imagine, they would even put their own life on the line just to help people like you out!!!

    DUI has been around for about 50 yrs actually, and it is worded as "Being under the influence of alcohol or a drug". It was so worded because of the high percentage of Truckies who took "yippy beans" to try and stay awake on long hauls (not because of drongo's who take liberties with narcotics. They're a whole different problem, and should be locked-up IMHO). I don't really want to have myself, my family, or my friends, destroyed because some stuffwit has decided to disable one of the only two brain cells he/she possesses, by drug usage.

    Ok heres a different cop story, A few years ago when vt's came out i was driving my vl turbo in a 70 zone doing 70. A red gen3 vt rocketed up from behind me slammed on the anchors to sit beside me for a second then floored it for a couple of seconds. I figured it was some guy with his new car, so i did a fly by and past him at about 120, braked back to 70 then he did the same, this went on a few more times until we hit a red light. As i was pulling up eager to drag i saw the red and blue lights in the back window thru the tint, looked in the window and he was in full blue uniform :eek: When the lights turned green he took off smoking his tyres, i took off like a grandma then ducked down a side street ;)
    They are only human, and obviously hoons themselves, some anyway
