I'm going to take a wild guess that surge tanks are illegal in QLD, but does anyone know for sure? I just need to know how well it needs to be hidden. ;)

Paint it black with a sealed rubber hose out the top going to the engine.

...It is now a 'vacuum tank'

Nice idea, but having a 1500hp rated magnafuel pump and big braided lines poking out of it will be a slight giveaway! ;)

Heres what I found for my car build,
If you are talking fuel surge tank, then its the braided fuel lines that are definately illegal under the car at least. Lines must be solid metal or rubber.
Tanks are legal for fuel provided they are tested which gives you a mod plate entry indicating its passed and you have a certification sheet from the assessor.
If its oil surge I don't think you an issue from what I found.
Its all about safety in these cases, braided lines are illegal on fuel because emergency crews cannot cut them / seal them quickly.

Briaded lines are not illegal, it is quite clear in the ADR37/01 through to ADR 79/02. They need only be efi rated, as a ppropriate to the system pressure. The real issue is that mr plod and inspectors are unable to check the standard (cheap copy), and not aware of the rulings. Or, making their own up.

In NSW any flammable liquids need to be sealed from the cabin.... so if mounting in tire well for example you would need to seal with sheet metal or similar.

Yeah, I was thinking about mounting it up near the diff anyway. Very hidden and a good place for it...
