I've been around even longer so that trumps your arguement. You have repeatedly had issues with sales on this forum and while often things get out of hand it is the way that you deal with the problems that is what most concerns us. You probably don't remember but about 3 or 4 years ago I bought a steering wheel from you, I had Trevor in Adelaide come down and inspect it and pick it up for me. You screwed him around for over a month during that purchase by failing to be home when you said you would forcing him to drive down to your house on three seperate occasions. Your customer relations skills have obviously failed to improve, so for that reason you are being banned from selling anything on this forum once the current smic debacle is over. If any business carried on in a similar manner it would be treated the same, and you have made yourself into a business by leveraging a group buy on the forum to purchase in bulk for personal profit.

The moderators are in complete agreement over this so don't even bother trying to appeal it.

 

While I'm not disputing the moderators decision, I think accusing James of exploiting the forum for his own profit is a bit harsh.

He organised a group buy for the forum and offered a price. What difference does it make how many he buys for himself and what he does with them when they get here... eventually?

I know other members have done and still do the same thing.

 

Look at the definition of Group Buy. Member A wants an item. Member A can get a better deal for his item by purchasing a min quantity. Member A offers that same deal to other members of the forum in order to reach min quantity. When min quanity is reached alll members get said item at the special price. No profit is generated. = Group Buy Forum

James' "Group Buy"
Member B sees a market for an item. Best price can be achieved on min quantity. Member B puts in an order, and offers same to members on the forum in order to reach min quantity. Member B ships out item to forum members and on sells extra items aquired though the bulk purchase at a profit. Profit is made = For Sale By Business Forum

We are not accusing him of exploiting the forum, we are just classifying it correctly.

 

Regardless of whether he's making money or not, the real issue is his lack of communication and attitude during the 11 month ordeal of the "Group Buy".

If he had kept all the "Group Buyers" appraised of the issues throughout, then this discussion would not be taking place now. At times it appeared that he'd fallen off the planet!

The moderators would not have been contacted by concerned customers and there would have been no threatened legal action.

The forum does not seem to be against people using the forum to aid their 300ZX related businesses but there must be a standard that these businesses adhere to. Any business that needs moderator intervention is obviously not adhereing to this required standard.

 

It's not like i'm making a profit from the members involved in the Group Buy.
All i'm doing is taking advantage of the cheap group buy price($500) to purchase a few more units to on sell at a higher price.

One other forum member here.. who wishes not to be named, also took advantage of the cheap bulk group buy price and purchased 10 x SMIC sets to sell for a profit.

ALSO.... 2 members from here purchased 5 x FMIC kits each from the last group buy to sell at a higher price.

Total SMIC purchased = 31
9 units = Members
10 units = 1 other member
12 units = Myself

I dont see anything wrong with it either which is why I put you in the For Sale By Business, although it would be good if you stated your intentions up front.. People seem to be confused about the issue here. The issue is as IB stated above...

I dont see why james should be banned, he didnt reallly do anything wrong. Although there was a lot he COULD have done to ease the situation he didnt. So I think he should be cautioned.

A lot of people were asking for a refund. As far as i can work out the money had been paid to the supplier, so it would have been difficult to issue a refund for everybody involved.

Next time james..... keep everyone informed.

to the discussion, i was amazed that this subsequent sale was allowed at all, following the absolute debacle of the group buy ...

.. it was not james fault ..??? .. do we know that ..?? ...no, we do not .. !!!!

.. hundreds of questions were asked ... james went missing, refusing to answer legitimate queries ... the tale changed according to the james whim of the day ..

.. refunds were offered, never processed only to be reversed when the SMICS miraculously appeared when the forum pressure reached a point of lynching ...

.. through all this, james has thumbed his nose at the forum and it's members ...
just check the last page of the SMIC posts, where he treated the whole thing as a joke .. after 11 months of member anguish ...

.. and to compound matters, the ongoing attitude of "i have taken you all to the cleaners" continues in the current "for sale" thread .. ".. mehh 4 sold today..." .. get the message guys ....

james has used you all on many counts .. with the total funds raised, he has never explained how much interest was earned on the total funds over an 11 month period and why that should not be returned to participants ... he has never said what the total funds were used for between payment and final delivery .. and now we find that he has used the G/B to fund his own purchases for resale while picking up ultra cheap shipping rates for his additional units by including his gear in the G/B purchase ...

the whole exercise stinks to the enth degree .. simply put, we do not need antics such as this on our forum .. and to put it very frankly, i think that the admin/mods have given this individual more than enough space ...

i agree, absolutely, with their comments and decision .. only wish that it had been a LOT more harsh ....!!!!

 

its pretty obvious that the For sale by business thing is right and no one is questioning that from what i can tell.

and before he got them it was simply a group buy where members got cheaper deals using their buying power AND his... fair enough it was a piss poor group buy and he didnt handle it very well at all... but i dont think he has done anything to stop him from running more group buys??? im sure the people that saved a hundred or so bucks are pretty happy (ignoring time frame which from what ive seen is only 1 out of a fair few GB's)

and baz isnt it innocent untill proven guilty... does anyone have any proof or even any reason to believe james was just stalling for some reason and his excuses were lies and he only came through because of forum pressure?? or what ever else?? i really doubt it

Just a note for anyone looking into these...

Once fitted you can no longer fit the sidemost light in the front bar (shown below in red circle)

The lamp fouls with the intercooler itself and short of making a custom mount that sits further forward you will not be able to have them in your front bar.

As for spash guards... they will all fit back on, however the parts directly below the intercoolers don't like it a whole bunch.

The coolers sit JUST above the bottom of the toe hook, so hopefully they won't be the part of my car that hits speed bumps and drive ways...

 

Are there any budget fmics or smics that actually fit without requiring modification of the rest of the car? I've seen quite a few ads that specify direct fit where direct fit can be loosely translated as 'take off the front bar and anything else that might (will) get in the way.'

I can't believe noone has called bs with these sorts of ads.

saying apart from fouling the indicator parker lights which will have to be removed to accommodate the smic, the splash guard, which will most likely need to be cut, and that any solid object taller than a field mouse will possibly hole either cooler, there fine, lol.
