    Appeal the EPA fine

    Because DBA's as Dub will surely tell you is a log arithmic scale 3db increase = twice as loud. Where whas his meter???? did he show it to you? if not it must be tested. Between 10-9pm on a sunday there are almost no Noise restrictions. I'd call up the EPA and ask. Also Lodge a complant at the police station. If it doesnt get you of any fines. the issusing officer will have to do about 8 1/2 hours to justify why he issused you the tickets. Write a statment of what he said.

    Sorry to hear mate...

    I heard that there are 2 types of defects:
    - yellow, which means you have 7 days to drive around before it has to be fixed
    - red, which means its tow-home. considered dangerously unroadworthy.

    in which case it sounds like they gave you a red defect

    any truth to this?

    i feel for you

    I love Victoria but we have the hardest cops in the land. I have been done time and time again for having a tacho mounted in the wrong place to having worn tyres. That by the way were no where near the wear marks. I got a $902 fine the other day for speeding. But I must admit that is my fault. However what you have been done for is truely amazing.

    Good luck getting everything sorted.

    The Victorian EPA issue orange defect notices. Whether this is just for emission related issues, or also for noise related issues, I don't know.

    I was permitted to drive the car away, I think I had 28 days to fix the problem and present the car for emission analysis. This was nothing to do with a Police/RTA defect, just EPA.

    Basically i don't even have 100 bucks to pay for fines or anything. so even if they fine me it'll be a LOOOOOONG time before they see any money from me.
    if i can get out of this i'd luv to...

    PLEASE tell me where to go and who i have to see and what i have to do....
    i got done in the afternoon so if what you're saying is true then he cant fine me coz there's no noise restrictions.

    i swear i wanna find this coppa and ram a pole up his ass (although he'd probably enjoy it)... coz he's made my life shit at the moment.

    my understanding of defect notices

    TO MY KNOWLEDGE... correct me if i'm wrong

    there's only one defect sticker which is yellow in colour. the fine and defect notice that comes with it determains what you are and aren't allowed to do, if its a major or minor notice, if you can or cant drive the car after the notice has been issued, if a RWC is required and etc...

    my friend got done for being too low. he got a minor notice and he had 7 days to get it cleared, which meant that all he had to do is show up at a VICROADS office and let them put the roller under his car and get it cleared.

    mine is completely different. i got a major defect, had to tow my car home, and get a roadworthy cert after its all done.

    and speaking of which i gotta remember to put the spare tyre back in the car... heheh (took it out for weight reduction hehehe jkin)

    i have to admit i didn't know about the 4second thing with the spare tyre... lucky we got someone the knows... thanks Paul (method)

    that reminds me of my mate... one of our boys night outs... we went past a coppa that had pulled some poor bugga over (god knows what for) and my mate being off his head... decides to scream out "FARK THE POULEESE..." and do a cowboy "YEEEEEEHAAAAAA"...

    They decided to leave the other guy and follow me coz i had the pouleese magnet (P plates) and a zx. they pulled me over and i had to kiss their asses to let us off and tell them he's drunk and for him to appologize. they ended up laughing it off and tellin us to get home and not to cause trouble... all i have to say is the powerwindows lock saved my ass that night after that incident.

    anyway thought i'd share that story with u guys... dunt ask why... hehehe

    Gee the copper played you.....

    yellow or the "Canary" you have 7 days to get the car fixed and yes you my drive it straight home or to the repairer.....you are not allowed to drive it around the country side no matter what people think.

    Red is towaway job end of story.

    the epa orange means you can drive it anywhere but in 7 days you must clear it from an autherised EPA station.

    Think about this up in queensland I would pull over coppers to defect my rig {so the boss would fix the piece of volvo crap} and they wouldnt....too hard.

    My advice is...

    you need understand the laws and regulations in Victoria (where both you and I live) before making an appeal of any sort:

    Note 1 - Roadworthiness Requirements (#26):

    * Section A : "There is no requirement for a spare wheel to be carried on a vehicle and the Standards for Registration exlude wheels not normally used in a service from any requirements. However, where a spare wheel is carried it must be securely retained in or on the vehicle."

    "Tyres - All tyres fitted to the road wheels of a vehicle, must be of a type constructed for normal road use must a minimum tread depth of 1.5 mm at any point on the tread normally in contact with the road surface other than at tread wear indicators"

    VicRoads - Roadworthiness Requirements


    Note 2 - Environment Protection (Vehicle Emissions) Regulations 2003:

    * Part 4 section 10. Noise emissions from motor vehicles : "For the purposes of sections 48B and 48D(3A) of the Act, a passenger vehicle must not emit noise exceeding the following relevant level -- 90 dB"

    EPA Victoria > Publications > Legislation > Regulations


    PS. I got busted doing 86km in a 60km zone on the same day, but I have no one to blame but myself.

    In my case the cops were very nice, as I was doing over 25km which means I would of lost my license - but he dropped the speed down to 84km which means I walked away with $200 fine (3 demerit points) and my tail between my legs.

    They inspected my car, and could find nothing wrong (which I'm sure they tried) - and I even still had my Dyno printout on the passenger seat!!! So if your car is legal, you should have no worries with cops

    I would still make sure, as I got this info from VicRoads

    when we were getting my friends 180sx checked out there. The problem with our system is VicRoads 'state' one thing, VicRoads 'staff' state another thing, Coppers 'state' whatever they want to and the courts just agree with the coppers unless your lucky.

    I would be real sure about how you go about getting out of it.

    If the filth that pulled you over gets wind of it you could find yourself getting more attention than you need for the next few months.
    REMEMBER...they know where you live.

    Just call the EPA and find out the Req's for noise emissions at the time you were booked, ask them to send you the Law and ammendmnets to the law.

    Contest the Fine, Get Legal aid. Call the EPA and complain. then call the police station and get the sargent to explain the law to you. Ask him if you can record the conversation. "Can be very helpful later on". then call the issusing officer and ask the same question. I bet you will get two diffrent answers. ask to record this conversation as well. "Great stuff in court."

    Then Argue that the police didnt measure the dB reading with a measuremnt device. Argue that the Legal requirement for your cars exhaust is 89dB and how the two must be comparable. hopefully the Judge will see this as a noncence. If they cant legallay measure it they cant fine you.

    BY ear isnt enough, Just like I estimate he was going 125kph in a 100zone, "If he dont have is speed estimation certificate it is nul and void in court."

    Even if you loose it will only cost you an extra $115 if you are right you will get them new tyres. Dont argue about the bald tyres get them replaced and bring the recept to court.
