    sorry JP...

if the bar doesnt fit properly and needs serious modifications to fit like many carmate bars, then you could easily argue its not fir for the purpose it was sold.

    Link

False and misleading conduct = this is a real easy one, just have to prove the average person would be mislead in this transaction.

    Link

This is a good one, as UAS implies quality (people on here have confirmed as much) Car mate implies junk (people here have confirmed as much) so by saying UAS quality is implied, however what was received was carmate junk.

if the bar doesnt fit properly and needs serious modifications to fit like many carmate bars, then you could easily argue its not fir for the purpose it was sold. haha you couldnt argue that a misfitted rear bumper is not suitable for purpose, missfitting yes, not suitable no... plus has it even been fitted yet? all this talk on misfitting and it hasnt been unwrapped yet...

False and misleading conduct = this is a real easy one, just have to prove the average person would be mislead in this transaction. What was misleading, it was still a bumper for the right car in the right design, not as good as what was expected maybe but not a clean cut misleading as you are making it out to be

This is a good one, as UAS implies quality (people on here have confirmed as much) Car mate implies junk (people here have confirmed as much) so by saying UAS quality is implied, however what was received was carmate junk.

so because UAS has a reputation for quality you can sue them because it wasnt as good as everyone says it is?

Surely UAS don't take a week to decide wether or not there will be compensation? It really isn't as mind-boggling as you might think.

    Rob,

    For the damaged product.

    mods are asleep

RBPs recieved, guidelines clearly breached numerous times, people pleading for it to be locked but no action taken.

I think (given history) it's obvious if the flame war is about UAS then the mods dont really care? and sit back and let fly. The old 'we cant monitor every post straight away' doesn't fly as RBP's have been submitted and this thread is pretty hard to miss as it is.

This lack of requested action has become the "norm" rather than the exception.

I have mentioned it once or twice in the past and received warnings for "criticising Moderators"(I'm not sure who else is controlling this area).

Is it a case of "the inmates being in charge of the Asylum", who knows?

Romonski's post aside, UAS i do not feel your doing your self any favours.

If this was my business and someone was openly critical of the service they had received i would be doing the utmost to please the customer IN front of my potential customer base.

Its obvious that if someone comes to you direct instead of going to Carmate then shouldn't that say something to you in regards to why they came to you direct?

If your going to deal with an outside supplier, its in your company's interests to quality control the products going out.

As for packaging, lots of companies design cardboard boxes big enough to ship a bar im sure the added cost can be incorporated into the final transaction if you feel it breaks into your profit margin too much.

Even back here in the UK, I've had body kits shipped to me with better packaging, and i can guarantee it costs a lot more to package it over here than over there.

also, given the feel for carmate products on the forum, and that the 300zx community is obviously aware of the short comings of the products, i find it surprising that you would deal with a company with such a bad reputation, given the concerns of the community.

Surely the wise thing to do would be to offer the same product of a better quality (as im sure thats what Romonski was expecting when he visited your website and put the order in), well packaged with a bit more customer service air about it, i agree that Ramonski should of contacted you direct first. but also that you could of handled the situation a bit better your self.

It would also help with a bit of transparency on your website, had the product been listed as manufactured by Carmate, Ramonski would of been in a better position to judge for himself as to whether to put an order in or not, i fail to see from your description how someone can honestly make an informed decision to purchase an item if all the information isn't available to start with, and comes across as underhanded.

I do not live in Australia, but from what i gather, people approve UAS as a means to gain quality products as thats what they associate your name with, surely its in your company's best interest to make sure they get a quality product.

Can't get any clearer. No "twisty, curly Engrish" to make someone look pseudo-intellectual. Just pure, clean words... direct to the point. Very well put...

I would have handled it different if my company was not rubbished to start with. Although I do not blame Romonski for informing the forum.

Blackbaz re being a piss pot, it was from what I hear. The way you carry on and are so cynical you should hope you had been drinking.

Inacuraely accusing any business of being criminally negligent is inapropriate.

yes but by responding the way you did to basically a member of the community that had nothing to do with the original post, could show lack of respect for the customer base. this is bad business as it reflects on the company.

Personally i would of brushed that aside and actually responded to the OP about what he would consider a reasonable outcome, ON the open forum as that is what he seemed to want. thus showing your [potential] customers that it can be handled amicably in plain sight with nothing to hide, not only would that of reassured people who may of been put off by the original post. but also means no one can twist what was said, and shows that although there was bad criticism, that you can take it on board, learn from it and get the problem sorted out.

Had i received a product that cost so much, carelessly packaged, all that would of done is remind me how little respect for me as a customer i was to the company that sold me the items.

these are our pride and joys, and something that costs over $700 should be treated with a bit more care before it gets to the customer.

too often I've seen companies try and play the "it was the courier" game, when in fact had the product been packaged better to start with, it most likely wouldn't of been damaged in transit.

Manufacturer aside, Looking at the photos im surprised that the side skirts even made it to his door with out being snapped in half, there is no support structure in the packaging to stop unnecessary bending of the product, no buffer zone around the product to stop unnecessary load being placed, or protection from sharp knocks.

Now if it wasn't your company that packaged the product, and that was my company id be straight on the phone to the people that did, demanding that they sort it out in the future or face losing you as a supplier, as its started to reflect on your own company's reputation and good name.

I'm not doubting your ability to run your own company, i just think from what has been said here, there is room for improvement. would be nice to see this sorted out with a happy ending, and see that there is a company out there that is willing to go out of its way regardless to make a bad situation into a good one.

I think UAS is taking a lot of flack due to a company that already has a bad reputation, no point letting Carmate end up destroying your reputation based on their in ability to package products that people have paid money for.

But also would of helped had he been aware that the product that was being sent, was from a company that had such a reputation.

Anyway, thats me done on this matter, i wish both of you the best of luck with sorting this out. i think it would be a good idea for Romonski to realise what he did was a bit of a hot headed moment, apologize for the forum out burst with out contacting you first. and see if there is any agreement you can both come to terms with that suit both parties, that isnt unrealistic.

    Good luck Unique Zed. :)
