Well yes i was driving along today in the right lane, i changed into the left lane and about 5 seconds later a celica decided it was a good time to move over too, by this time i was at the speed limit, and she was going about 5km/h, tried to brake but not much stopping time, so front bar, drivers side front guard and possibly suspension damage, there is questions over who is at fault, but will see what happens when she makes her statement, hopefully its not too bad though
Should be cut and dried Byron, if she changed into the lane you were already in she is guilty of "Not change lanes with safety", and proof of that is that she got tagged by you. You changed lanes safely, she did not.:bash::banned: My account is in the mail.:biggrin::zlove:
i know that and you know that and everyone i have spoken too knows that except the insurance company so i will see where it goes, if i end up at fault i would say i will fix my car myself and cancel the claim, bu we will see where this road takes us
If she is insured you have the option of claiming against her insurance by billing her for the repairs(this is sometimes helpful if there is some likelihood of your car being written off by your insurance company). Her insurance company doesn't have the option of writing off your car.
So, if she's at fault and say there is $15,000 damage to BlackB's car (and say it's market value is 12k), her company has to pay out that $15,000?

I really hate these sorts of situations (victim of a few in the past - all clear though) It's a very tricky call as most moronic assessors side with whoever has the mangled ass, despite the events that led to it. I'm very careful when changing lanes, and I drive according to the prevailing conditions, but as you know, most people on Sydney's roads are late for something. You can't avoid these sorts of situations if you have no safe outs.
Similar thing happened to me last weekend - however I was in the left hand lane and an African guy merged on top of me. I was right next to him, slightly in front and I saw him indicate and start comming over at the same time. I was on the horn and tried almost off the road trying to avoid but he kept on comming. Damage to drivers mirror, door and real 3/4. Mostly paint but dint on 3/4 panel. He gets out and is saying 'what are you overtaking me for???!!!' and I'm like get stuffed I was already in this lane, and I was on the horn, AND YOU KEPT ON COMMING!!! Oh did I mention started changing lanes thru an intersection? :bash:
Jesus, there's a fair amount of damage(mostly paint) but it would need half the car to be resprayed. Was this Turkey insured?:bash::zlove:
Yeah he was (insured), but I need to get quotes etc to go to them with - and I need to wait til he makes a claim so there is a claim number??? (or so his insurer told me). I'm having trouble getting quotes - comments like 'we wouldn't work on a car like that' and 'company policy is we don't work on imports' is what I am hearing alot of... 1 quote from 6 places The pics look worse than it actually is, but still a pain in the butt. Door is still straight and would probably buff out the scratches, but the 3/4 is dinted... I'm even thinking I may wait til my Gonzo kit comes and do the whole lot - will depend how difficult getting it on insurance will be.
PICS of damage Wheel is now running about 5-6 degrees neg camber (Visual Guess) was running 1.5 previously so there is damage to suspension components aswel and that wheel was in perfect condition before but is now very scratched but hard to show that in the pictures
