Oil Leak Nightmare Continues!

    Hey guys I need some good advice here! Some of you may remember that I had an oil leak in 2005 that was traced back to the gallery plugs on the cylinder as I paid for a Top end rebuild from Nisport.

    After some arguing with Spencer and help from you guys and Simon from TTZ I had got Spencer to cover it under warranty. But the oil still kept leaking and he first told me that it was from the engine bay due to the previous leak and that it would take a couple of months for it to go.

    After a couple of months I call back, the oil is still leaking, and he isnt there and Andrew is running the shop. He tells me its must be the cam gears and to bring it in the following week. The following week he cancells due to other commitments and I tell him that I am going overseas for like 8 months and wont be back end of 2006. When I get back I call him and Spencer is there and he is saying roughly how much it would cost to get cam hears around $600 for used etc so I start saving and I call him in Feb asking when I can bring the car around. He is telling me about how he is moving shop etc doesnt have time. I finally get him to look at it in April and he tells me again that it is the cam hears after looking under the car but he doesnt have a mechanic and he wont have he shop running until next week. Well I keep calling and he gives keeps telling me next week next week. Then I get fed up as I am moving to QLD and take it to wallards wallards look at it and sat it might be the cam gears but they cant be sure until the take it off and when they do they see that it is 4 plugs 3 at the front and 1 at the back.

    I then confront Spencer about this and he tells me that it wouldnt be covered under warranty as it was almost 2 years to which I add I had only done 10000km's from when the top end rebuild was done and I actually identified the leak straight away and it was him that was initiating the delays. To which he replied that he would look at it and then decide what to do but he is fully booked until the end of June. I tell him clearly that I expect him to honor his work and word or else he should refund the money. he tells me he will fix it at the end of June.

    End of June comes and I call and call and call repeatedly leaving messages but I get no answer until today as I am back in melbourne and he tells me that he isnt at the shop and he doesnt know when he will be back and he will try be back next week. I tell him that this is unacceptable and I need this to be resolved to which he replies "do whatever you have to do!" and then hangs up!

    What should I do guys, i paid over $4000 for this rebuild had my engine pulled out 2 and had 3 timming belt changes plus all the other parts and oil changes and my car is still unroadworthy and I cant get it registered. Is there any chance of if not recovering all my $4000 at least recovering the cost of me to get it fixed by a proper professional? Or should I just take it on the chin? I really dont have the money required to fix it as I was told it would be atleast $3500! Please help!

    I say call fair trading,

    give them a call and see what they say, they shoula addvise you on what to do according to the law. hope it gets sorted dude.

    You need legal

    advice mate! From what you have said, I can only see more stalling and bullshit from nissport, put the heavy roller over them.

    Nissport is an unregistered business!

    The problem is Nissport is an unregistered business and I have no paperwork, i was never given any recepits or statements of work. Everything was done by word of mouth and cash, i dont know how legit this is.

    It was probably quite naive of me, but then I realised that there are probably a lot of people out there who have been or still goto Nissport and dont get any reciepts or statements of work and just hand the cash over! I will contact a lawyer tommorow, but I just wish there was a better way to work this out!:bash:

    You can pay by cash but you should always ask for a receipt. I dunno if you're gonna have much luck. Did you have any e-mail contact with him? Talk with him on any public forums, even by PM? Keep everything on paper or e-mail you can. That might be the only proof you have.

    Don't like your chances. You have been using the car for over 12 months, regardless of the number of K's you have done you have no paper trail to support your claims. If it was me in the mechanics position I wouldn't be fixing it (unless you where a customer he wanted to keep).

    Always get everything in writing and keep a copy (my boss keeps drumming this into me). Good luck, but hmmmmmm.

    No but its not like he is denying what has happened.

    Infact he has not even denied the warranty he is just completely avoiding his duty to honour the warranty.

    Paying cash is

    fine. Small business can earn up to 10k cash, tax-free, it?s not illegal, and anything above that is taxable. I would have insisted on a parts supplied list, showing the cost if I were you, because without any documents, its going to be hard to even prove nissport did that work, its your word against their's. Forget the heavy roller, unless you have plenty off cash.;)

    Has been heavily promoted as the preferred place to take your Zed for repairs over many years by senior members of this forum.

    After such heavy promotion and endorsement, maybe now is the time to offer some advice here in what appears to be a very unsatisfactory situation.

    What does unregistered business mean? I looked them up on the Consumer Affairs Victoria Website and "Nissport Z" comes up...:

    Let us know how it goes... I was hoping to have a talk to them about my waterpump failure...

    i guess this is why nissport and the z shop have such terrible feedback on this forum from "ex customers " and there sure is enough of them :eek:
    What i find hard to believe is when all this comes up,the owners are no where to be seen,in fact for such so called enthusiasts,they never even come on to the forum to keep their reputation in contact or show any concern whatsoever :mad: :mad:
    And Tony,they may have heavily been promoted in the past,but they are not any longer
    My suggestion is go and visit him at home,its amazing how quickly things get resolved when u do that,none of this what happens at work ,stays at work crap,this is the real world,with real people,they forget that !!

    are also not listed in the whitepages.

    After a recent "dispute" with a phantom Z owner who made some pretty serious allegations against Z Shop, I found this post and others from Bob at the time a genuine attempt to resolve the problem

    Ok Bob is not an owner but he is an affiliate of Z Shop and was comitted to achieving a resolution.

    Guess time well tell whether Nissport have the same integrity

    Yeah i do agree there Tony,i have seen Bob making a good effort on their behalf which is nice to see :)
    I must also say ,i myself have never had work done at either of these places (i do it all myself),so i have nothing to offer in the way of bad experience,in fact i have heard some good experiences so that is refreshing in itself :)
    I guess where ever you go you will hear good and bad,it just seems there is alot of bad lately :(
    As far as the mysterious phantom Z owner,i understand he is the father of a member on here,and seeing he didnt elaborate any further,maybe he had no cause for complaint,i guess we will never know that one ??????? :confused:

    Replaced your PCV valves ?

    If your Postive crankcase ventilation valves arent opening the pressure of any blow-by will pressurise the oil system. This forces oil out past seals, usually the rear main seal and pops the dipstick out.
    Maybe not the cause but surely and agravating factor.

    I think the PCV hoses can get blocked too.

    i live 5 mins away from nissport i've stopped by occasionally to see spencer when the car plays up. i'm familair with the situation there so perhaps i can share some info with you.

    firstly any work i've had done has always been invoiced regardless of how big or small. from regular service to clutch changes etc...

    andrew ran the shop by himself for a good year or so, he stopped working there 6 months ago. did he rebuild your motor? if not it's probably safe to assume he doesn't know anything about the problem and what he told you might just be a common cause and incorrect. the timeframe (april) when you rang spencer he was relocating the business and doing less than 2 days a week with a garage full of cars so not surprising he gave u a rough guess of end of june.

    it's on the way to work so when i drive past the old workshop it's usually closed and i'm guessing most likely he's still relocating and only there a few times a week. my car is due for another good service with a few things to fix up and basically he isn't able to take any new work at the moment (even to fix small things) so don't hold your breath mate.

    Nah. The rebuild was done in 2005 when Joe was working there.

    The first oil leak was supposed to be fixed under warranty. Joe saw that all 8 plugs were leaking. Then after complaining they fixed it but I noticed there was still a little oil leaking and that when Spencer gave 2 incorrect diagnosis, it being oil in the engine bay, and then the oil was leaking from the cam gears. When it turns out according to Wallards to be comming from 4 plugs 1 at the back and 3 at the front. I mean the least he can do is get one of the mechanics to look at it rather than telling me he knows what he is doing and getting underneath my car etc.
