Entrapment? Longish.... may contain conspiracy theories

    I recently heard a story involving what I believe to be a case of out and out entrapment. I would like to point out at this time that I do not condone the act of street racing and anyone who does get busted most likely deserves what they get cough* myz's better*

    Anyway the story goes, a fellow car enthusiast was out enjoying a cruise when he witnessed a brand new BF Falcon XR8 equipped with the racing stripes and P plates, pull over a speeding vehicle. Yep the car was an undercover police vehicle...incident occured in Sydney.

    Anyway this came as somewhat of a surprise to the hero of our story...however the bigger shock was yet to come. A short while after having witnessed the undercover cop in action, our enthusiast recognises the same car in front of him...the copper sees that the enthusiast is driving a modded car and proceeds to slow down, flash his hazard lights and then take off...yep the undercover cop was attempting to initiate an illegal on street drag race with the intent to book my mate should he accept the challenge. Well needless to say my friend (lets just call him michalis) was none to keen to participate in any activities that could land him in front of a judge and continued at a legal pace behind.

    Now is this or is this not entrapment? The fake P plates, the hazard light flashing, their intent is blatantly obvious and most assuredly illegal.

    Has anyone else witnessed similar occurences. I'd be keen to know if this has been a tactic employed by one rogue highway patroller or perhaps part of a larger syndicate designed to seperate the enthusiastic and perhaps foolhardy from their vehicles. Come on I just love a good conspiracy theory dont you? :cool:

    :LOL: Sounds like another night on the gold coast.

    It is not Illegal, AS LONG AS... The police themselves don't exceed the speed limit or break any road rules.

    This is happening everyday and everynight, i myself have had a similiar experience,

    I refused to race, instead i took off as quick as i could sticking within the speed limit, :( Problem was my damn wheels couldn't hold the traction through 2nd to 3rd and I was pulled over and questioned about it. I explained that i didn't appreciate his tactics and he should be fined. The policeman was nice enough, but simply said as long as they do not break any roadrules themselves nothing can be done about it.:thumbsdown:

    I can think of plenty reasons why it should be illegal

    The number one reason being it is entrapment pure and simple, you cannot tempt people to break the law only to bust them for a crime they would not have otherwise committed. Secondly isn't it illegal for non P platers to display P Plates, surely a finable offence at least and finally they were most certainly exceeding the posted speed limit.
    This kind of thing should not happen, I suggest if it ever is witnessed that we should report it. As the testimony accumulates sooner or later questions will be raised. Another friend of mine has suggested sending such testimony to the Shadow Police Minister.
    Have these reckless pigs considered the lives they are endangering in the process of this revenue raising. What happens if the driver of a vehicle they have encouraged to race loses control and wipes themselves or others out. This is precisely the kind of incident that prompted the laws against street racing in the first place.
    If your unfortunate enough to fall for such a scam I would encourage you to take the matter to the courts and try and raise awareness amongst the community, short of securing footage of these hooligan cops, legal action is the best way to deal with such behaviour. In the words of Rage Against the Machine F**K the Police!

    Correct me if im wrong but

    I'm no expert and im sure Neshy could clarify but I'm pretty sure the rule of entrapment is very strict in the fact that it only applys to murders. ie you cant tempt someone into murdering someone else to arrest them.

    Think about all sorts of undercover sting operations the police pull. Especially posing as prostitutes to arrest offenders. None of this is considers entrapment.

    At the end of the day the answer is simple, dont drag on the streets.

    Just my opinion, feel free to correct any wrong info.

    entrapment, or plain and simple tatics to bust you

    I have had pigs attemp to lure me in a drag race. luck the week before they pulled me over in a marked car, so i knew they were cops, rev it up, trying to stage it. so i played along with it for awhile. i punched it from the lights till i hit 50 then just drove normal. they were just smiling. assholes.

    For enthusiasts

    like your friend, they have nothing to worry about if they dont drag race any car. For punks who go all out and race and continue at speeds well beyond the speed limit, well entrapment or not, sucked in, they deserve their licence gone. A licence is a privalige, not a right.

    So long as the police dont break any road rules and endanger the public doing it or pulling over people without justification, they can pull this off on anyone in my books. Time to weed out the people who dont deserve to be on the roads.

    Also lets face it, the more this sort of story gets around, the less people may drag race (assuming instead they are being baited).

    Is this flashing hazard lights thing supposed to be a signal for 'lets street race' or something?

    Not sure bout the Hazard light thing, never seen that happen..

    On several occasions i've been baited by police, and 9/10 times they have almost caused more hazard on the road than if 2 street racers would.

    Don't get me wrong, i'm not condoning street racing, but if you'd have seen the way these police drive you would even agree that it is stupid, dangerous and putting peoples lives at risk.

    It seems they are too busy watching the vehicle they are trying to bait instead of the road ahead.

    Really is a dangerous practise and something should be done to stop this happening. It is only a matter of time before the police make a mistake and someone does die from this behaviour.

    Im not sure about it but aparently its something you do when you win a race.........FYI I dont race illegaly (need my license for work) but have seen plenty of those as passenger and on american racing videos.

    I would have thought that there were rules against flashing your hazards in a non emergency. That could be one avenue in booking the police.

    had a related experience after coona on my way to victoria .. a white

    ford xr8(??) turbo, white, unmarked but with a giveaway high aerial on left rear guard .. kept accelerating, slowing down, ahead of me .. and clearly baiting me .. we were the only two cars on the road until another vehicle came up from behind me and passed us both, a bit above the speed limit .. portable light starts flashing in the unmarked and the third driver was nabbed ..

    thank god for a little suspicion and some patience ...

    Saw a really nice dark blue GT-P police car the other day travelling along Parramatta road. Was tempted to catch up and admire until I saw the electronics in the car.

    Also saw a blue mini cooper S police car, again along Parra road. Never seen one of those before, definately something different.

    The police are becoming very sneaky :cool::cool::cool:. Take care everyone on anzac day

    There was a white XR8 yesterday on the cruise

    with blue racing stripes and all. he just looked like he fit in with the crowd. we stopped to fill up for petrol and then along King George's rd we saw the XR8 had pulled over a car and was defecting it! it had red and blue lights flashing on the dash and everything. I was shocked!

    But after reading what Sabrewolf wrote, that sounds right. it sounds like entrapment, but i don't think it would stand up in court, cos either way, he broke the law. :thumbsdown:

    we live in australia, not america, we dont have the defense under

    entrapment, its perfectly fine for the cops to do it, and im sure they are encouraged to do so by their superiors
