It should be a felony to hit a Z regardless. Why didnt you smack him up the chops and claim it was an automated response? Why did'nt the police take action for his negligent driving. (not in full control of a vehicle at least) The time of the accident and the phone itself is the evidence (Time of call recieved or sent) - Police like sticking it to drivers with phones! It's a write off, going in Monday for his insurance company evaluator to look at it and try and shaft me (Let's be honest, he IS going to try and shaft me). Im not taking less than 6.5k though as it what it will cost me to get back to where I was. Might take this opportunity to get a 2+2.

What ever you do don't say you will settle for 6.5k as they will then know thats what you want and only offer less. Say you won't 10k and nothing less and don't bend from 10k until they raise there offer to a min of your 6.5k. As long have you have time ( a car to use )don't rush or think you have to do anything tomorrow. Say to them that they can go out and get a replacement that you approve of with no more than the same k's as your and condition if they offer you less. I'm betting they won't want to spend there time looking. Also tell them you have seen a lawyer already and have been told that it is you who will set the price not them. They like there lifes as easy as they can get it so are usually happy to get you out of there hair and move on than waste time and money fighting a battle with you. Happy hunting Dave
Yup I reckon $6.5k will be pretty easy to get out of them as they're well aware being rear ended at a set of lights gives them no real grounds to fight regarding liability. They know they have to pay you out... but they'll try to get out of it cheaply. Agree, say you want $9k or $10k to start with.
Floor pan did take a hit too in the end. Assessor has submitted his report to CGU and is saying $8k. Not sure what the salvage fee would be to buy mine back exactly but he reckons around the $800 mark. Just have to wait for it to be processed now, fingers crossed, $8k would be a very nice outcome
If they are saying 8k...say you want 10k because of its condition and it not being your fault. Sure 8k is good but 10k is better... Abraham
Im not going to push my luck as I KNOW my car is not worth $10k and so does the assessor. $8k I am happy with.
Im insured for 15k now but need to update it because of my respray and new bar and rear skirt...should get it upto atleast 20k. If some idiot is stupid enough to write off my car, i will milk him for everything he has got and i would mess him up!! If im insured for 15k i would want atleast 20k and i know i would get it. I still remember getting 10k for my trade in value before my recent updates to it. So i am more than happy with my zed right now. Just hope it works out all good for you. Abraham
Update - Just waiting for the guy to pay his premium and I get paid. Unfortunately this means if he just doesn't bother to pay it, I never get anything.
yeah, and considering his car is perfectly fine as all I did was leave some of my paint on his bullbar, he has no real incentive to pay either.
Finally got hold of the solicitor handling it all for me, if he doesn't pay by Monday, he's suing him for me so just have to wait and see.
I'm pretty sure even if he is insured, the insurance company is still obligated to pay you out? Do you mean waiting for him to pay his excess? Nothing stoping the insurance company paying you out and chasing their client up for the $$$.
