Pulled over by a cop last night (long)

    I finished a uni exam at 9:30 last night, pulled onto the pacific highway at Kuringai and gave it a bit from the lights. One minute later, that awful siren and the blue and red lights....I have to admit, i was a little worried. I pulled into a service station, and the young cop, who was by himself came to the window. He said he had clocked me at 104 in a 60 zone, that i had done a burnout from the lights (which i actually hadnt, but anyway), and that i didnt have a P plate on the back. He was looking pretty smug, and i wasnt feeling too good.

    He asked me to open the hood and get out of the car.

    Pod filter. Atmo BOVs. Front mount. Car too low at front (hard to believe, its not lowered)

    Then he went to the back of the car.

    Tinted windows too dark. Tyres smaller than original fitment. Exhaust too loud. I think there was more, i cant remember.

    By this time i'd done a bit of maths in my head and was thinking about 3 grand in fines and at least 12 months suspension. It wasnt a good moment.

    He went back to his car for a good 15 minutes (i know cos i was late meeting my girlfriend) then came back and told me the tickets would be mailed to me within 28 days.

    Has anyone heard of ticket being mailed out? wouldnt he just give me a ticket on the spot??

    Does this mean he's just let me off but wanted me to be scared shitless for a month, or am i screwed?

    You should have got the fines there and then but it wouldn't surprise me

    if you get a letter to take your car through the pits, in which, either way you are screwed unless the pits there arn't tight, and you know a mechanic who can do a leniant RWC. The only reason why you wouldn't get them is if he didn't have his book, or had ran out of paper. The BEST thing you can do, is go down to your local police station, ask them what the hell is going on and explain to them the reason you want to know is that if you are getting fines for all this, you need to start *fixing* what you got defected for.

    Mailed to you?? I always thought that they issued Defects etc

    on the spot?
    Also how did he know you have a pod filter? Is yours visable thru your front bar? Unless he knows the sound(unlikely) or he asked you to unscrew the center piece between the headlights (also unlikely) im not sure how he would know u had one, its not like it sits in view like commies for example, so yeah unless its visable im not sure how he would know?
    But good luck anyway, let us know how it all pans out

    I have been pulled over by police and they have mailed it to me

    dont ask me why they just dont do it on the spot (lazy?) but yes, about 2 weeks later I got the fine in the mail just as he promised.

    Forgot to mention, in VIC you are allowed to either have a POD and

    stock IC, or an aftermarket IC and no pod. That is by the books.

    Funny thing is the car got engineered and complied as it is.

    But ive looked at the engineers report and none of the extras were listed.

    Hey Rohan

    Mate get yourself a lawyer and exercise your rights to have your point of view heard before a magistrate. No matter what else you did wrong there's no way you should cop a fine for a burnout you didn't do and from the sounds of your post I gather your car was complied in it's current condition which certainly makes your defect notice dodgy to say the least.

    Check your PM too

    Who is to say the modifications were not put on after the car was

    taken away from compliance. That will not hold up in court, you may however, get away on the burnout etc. Did you ask to see the radar reading?

    It may help to reduce the severity of the penalties. Also going through and pointing out wrongly issued defects like ride height (if it really is factory height) will lend some weight to that argument. I agree that you won't have the defects dismissed but if you can reduce the number of items you are penalised on it's going to start saving you $$

    I dont have any proof that the modifications werent done since compliance, its true. I dont have much of a chance with the defects i think.

    Thanks for the advice Rob, I have already started looking into contesting the burnout charge. I had just pulled out of uni, and didnt warm the car up so the car was cold and must have blown steam when i took off from the lights in front of the cop. It must have looked like the tyres smoking?? I dont know, then again how the hell would he get it so wrong? If only my tint wasnt so damn dark i would have seen him in my rear view mirror :)

    When i tried explaining that i didnt spin the wheels, the cop just started yelling "You're lucky i dont just charge you right now, put you in handcuffs! Would you like your car confiscated for street racing that red 323? I'm doing you a favour cutting you some slack!"

    I just reiterated that the wheels didnt spin and he started on about giving me a neg driving charge for not noticing! Give me a break... An auto car taking off normally then accelerating, on a dry road, with heaps of tread, doesnt do a burnout. well, at least mine doesnt.

    I have the stock air set up if you need to borrow it Rohan!

    Igore the suspension BS its stock tell that to the pits/mechanic. Usually found in NSW it means they are trying to think up what they can get you for. I got threatened with the book being thrown at me when I was driving the GTR without plates, with temp rego. Went to the RTA and complained, they called the police and told him where to shove his tickets. Ps I noted down everything the cops said, including him saying "the RTA dont know what they are doing", and passed this on to them. They didnt like what he had to say, and shadowed with "the cops dont know what they are doing" ended up with a $68 fine for no plates "what the" car wasnt regoed (temp rego to get it to engineer for compliance), dickhead!

    Call the RTA and have a chat with them, they hate the cops, as they fuck up all the time!

    It just wrecked my night... I actually killed the exam too!! The high lasted all of about 10 minutes...

    This is the one thing that im really paranoid about driving a zed

    Dealing with police that are on some sort of power trip giving you shit just because you have a decent car. Driving my EF Falcon or VK Commodore ive never once been pulled over, but im sure as soon as I get my Zed on the road im going to be a cop magnet.

    Coming back from the US on Monday I forgot to put my middle name in the Arrivals customs document and the Customs Officer made out as if I was an illegal immigrant and was giving me a grilling, gimme a break lol

    Ouch, sorry to hear this ...

    I haven't heard of getting tickets like this in the mail, but I have been given a delayed ticket which was personally delivered by police about 6 months after the event.
    I hope this has put an end to considering those other wheels and tyres you were looking at as they were also too small!

    Since when is a FMIC illegal?

    Also, I don't think the stock airbox will fit on there is a FMIC is fitted... or are they talking about the stockers? You've got 15 inch wheels, tyres being too small, you sure that's illegal, I only thought if they were too big? You can get the glass tinting tested in the day perhaps as when you got pulled it was at 2130 , so... get that checked like, tomorrow, Noise dB can be checked at an exhaust shop, 10 minutes if that...

    Contest the issue, by getting shit checked... speeding, would have to have been recorded also.

    You've got a little time

    to reverse any defects that could get you done over the pits. Just rock up and say 'I dont know what the hell that cop was on about, my window aint even tinted! These wheels came with the car, and that crappy air box doesn't look like a pod and how is this exhaust too loud? Its the original mufflers!! :wacko:'
