    I'm not motivated by trying to appear knowledgeable (it's reasonably common knowledge even to those not in the industry that this car can't be imported) nor could it be argued that I see this as 'competition' to the business that I'm involved with as frankly we can't import the car into Australia anyway so it's not like I'd be losing a sale. I am purely concerned that a member of the forum would end up paying for a car which may end up being unregisterable or crushed and losing a whole lot of money... I've seen it happen before.

    The simple truth is that this car is not eligible for import into Australia either under SEVS (no RAW in their right mind would import a car like this as their SUTI test vehicle given the mods) nor under the 15 year old rule, as that has now ended. This is not open to interpretation, these are the laws, the only way around it is to import illegally, which can have consequences.

    The only way this car could come into the country is if the purchaser were to illegally forge documents stating that the car was purchased before February 7th, which given that it is advertised for sale in a public and very well known place in Japan means it wouldn't be hard to prove this is not the case, and DOTARS is smarter than many think, they are monitoring sites and collecting information.

    If you can somehow show how this car can legally be imported as your importer friend is claiming I'd love to hear it and by all means post here, but if you read the link I've posted above you'll see that this is not possible, and I and I think anyone else who knows for certain this is the case has a hard time watching this happen knowing there is the possibility that a member will lose a lot of money on something like this.

    Sit down and have a rest mate, you've done enough work for today. When you have gathered your thoughts you can make a public appology. I want you to answer the following questions:

    - Do you claim to be psychic? If not then how do you explain your ability to know without a shaddow of a doubt that the importer I know, has not made a financial commitment to this car prior to February 7th?

    - If I legally get or have an import approval for this car, is it still illegal/impossible to import this car?

    - In your infinate wisdom do you think I would involve someone in something I knew to be illegal or dodgey? Do you think I am stupid enough to involve myself in said activities? and do you think I would walk into this with my eyes closed hoping for the best?

    Please Ben if you can offer some sort of psychic abilities then by all means jump right in and say your piece, otherwise I suggest you invest in a crystal ball prior to making ridiculous claims about things you have no knowledge of.

    And if you have the following....
    Then how about showing it.

    All I see here is one member trying to protect the other members from possibly buying a car they can never drive and you coming back with smart cracks.

    Look I would not put someone in that position, I will not take a deposit on this car until I provide the import approval, this is the arrangement. Take it leave it or whatever, I just think that if Ben is such a goddamn import detective then how about he comes and questions me directly, then if I don't seem to know what I am doing, or it still sounds dodgey then post something warning members. His posts have served no purpose other than to speculate, and put people off. Wykked if this is genuine and perhaps even a good deal, then don't you think that it is a bit rough carrying on like this. I tend to see it fairly regularly on this forum.

    People doing things like this is ruining a forum that is pretty much based on members helping out other members. I am not saying that he shouldn't put up a post like that, by all means warn people - but for the sake of common curtiousey it might have been and idea to at least ask me a few questions before flat out saying it is illegal.

    I think Ben is just trying to make sure all the facts are out there

    And the bottom line Scott is that most people here don't know you personally so your personal assurances aren't worth alot to potential buyers and miscellaneous sceptics.

    Why not set us all straight on the situation you'll do better with your sale :thumbsup:

    I'm speaking for me

    I have no knowledge re who the other people are here, but my own personal experience is as follows

    1]My car [ '90 ] was purchased in japan by an australian national prior to the publishing of the new regs in the commonwealth gazzette.

    2] I paid those people, who managed the purchase of the vehicle and its transport here to OZ, in full in June 2005 [ approx $8000].

    2] The car was placed on a transport in July and arrived here in july, with my name on the import papers using the "old" 15 yearsold laws.

    3] I paid the same people to broker/arrange the compliancing [ Aprox $1500].

    4] I then directly paid a national car transport company to transport it from their interstate depot, to my front door [ About $650 and 5 days].

    5] It is clear from a prelim rego inspection that i have all the paperwork [ import, reciept, engineers report etc] to get the car registered once it can be passed as roadworthy.

    so far so good :thumbsup:, and my experience supports scotzz's clam that it should be possible to "still" legally import a car under the 15 years rule provided it is a 89 or 90, and other details are covered in a legal manner.

    On the other hand, the bad stuff is that it arrived at my door with an extra 22,000Kms on it, a ripped open resonator, 4 totally shot tyres, a completely flat battery, a shot rear shock, and the advertised and pictured front aftermarket spoiler lip in 3 pieces on the back seat, exposing a standard lip with 2 rather promiment holes cut in it, the rear spoiler [ described as "lifting" in the advertisment - actually has both rear bolt holes of the hatch totally absent, due to rust and the resultant 3" diameter 1/2 circle rust gaps ? Obviously it has no chance of getting registered in a hurry.

    the "importer" says that it may have been a clerical error in translation that moved the advertised 85,000Km on to 107,000KMs and says "opps - sorry" re that, and that the car was fine re battery and exhaust when it was delivered by them to the transporter - gave no idea re the front spolier or re the rear rust, the transport company says "prove it was us" re the exhaust and battery. Since i could not start the car when it was delivered, how can i prove that the damage was done after delivery to them, but before delivery to me ? answer is - I cannot

    The "importer" now says that I should still be able to sell it for more than what I paid for it [ about ($9,500), but offered to buy it back from me [ minus what I paid for transport], I replied "please do" a week ago, and have heard ziltch since.


    Perhaps this is an honest business , and they are just doing the best they can, and we have BOTH been had, and/or this is just one of those deals where nothing go right for anyone, but it is the only experience i have had and it would seem to me that both sides in this tread are right - yes it is possible to still get a car "in" at the moment quite legally using the 15 year rule, and yes it is possible to have a totally SH^$^%#%T experience with car importation, even using a business that has imported hundreds of cars [ as this one had]

    I hope I have not hijacked this tread, I just would like to point out that both sides have good points in respect of advising new members such as myself what to be concerned about.

    You may have the best intentions to get good cars for members you lack the evidence that its a good car.

    You have 3 photos. and a description of those photos. There is no mechanics report or further information.

    If your importer has made a financial commitment to this car (prior 7 Feb) surely they would have checked it out very thoroughly and provide condition reports etc. Why arent you providing this information?

    Also if you importer has a list of cars they have made financial commitments on. why dont you post up all of the cars?

    Scott I was trying pretty hard to give you avenues out of this and not saying anything specific, but so be it:

    The owner of the car told me.

    You can't do this legally, in light of above information from the owner of the car himself, only by forging documents.

    Maybe you should have another talk with your importer friend.

    The facts seem to do ok without need for my legendary pshycic abilities.

    Scott, if you or your importer mate wants to send back dated documents to DOTARS and possibly get import approval that way, that's up to you guys and you can live with the morals of such a decision if you see fit, I don't really care. But if you are importing the car for someone without telling them or letting them know the potential consequences of this then that's not on.

    what I dont understand is how a person can claim to have a financial commitment, but the car is at an auction which would mean technically its fair game. Im not trying to have a dig at Scott but trying to get my head around how this is expected to go down.

    Well we'll see...

    The story I have is that there has been a refundable deposit made on this car by my dear friend the importer. This deposit was made on the basis that if he chose to follow through with the sale then the importer would receive the deposit amount off the end sale price. If in the event the car was later sold to someone else then the importer receives most of the deposit (not sure of specific figures) back.

    I am going to have a long conversation with my friend the importer, I will take to him what you have come to me with Ben. I trust this person and so I doubt that he is lying to me, however who knows?

    Anyways I will speak with the importer and also to the person who has asked to buy the car. If there is something dodgey going on then no one other than the importer is at risk, so I don't know why he would accept all that risk, but as I said who knows?
