its no big deal, so I dont mind posting here but was wondering what you guys thought about it, and if any lawyers were present, what advice they would give. Anyway, got stung $100 fine for parking on a clearway at 8:50am in the morning. You're not meant to park there till 9:00am, but I didnt get out of my car till 9:05am. But, instead of Mr brave parking officer coming up to the car and giving me a ticket, it was sent in the mail instead. I do admit I was parked there early, but are their any loop holes out of this?Cheers
check out the laws... regarding parking fines whilst still in the car. I've heard that you cannot be ticketed if you are still in the car, as its not 'technically parked' if there is a driver in it.... you'll no doubt have some law/bylaw regarding this...
Was it a Clearway? >>> If it was zoned as a Clearway up to 9:00am, or if it was a No Standing zone, I would think you would be struggling to avoid the fine.
yeah, twas a clearway..... but I was hoping that because I was still in the car, I may have a loop hole. Mind you, I wasnt the only one their, as most people pull out early to park on the clear way.Cheers
Standing vs Parking If you are sitting in your car (in the drivers seat only) you are officially regarded as Standing, not parked. If would be worth finding out what the rule is regarding standing in a clearway.You can be fined straight away for standing in a zone in which standing is not permitted, but most parking officers would tell you to move on if you were still sitting in your car.James

Come on Jedi, don't hold up Punt rd ! Its a nightmare to get through there without any parked cars, and infinetly worse when everyone has to merge into the right lane....I reckon you would have earned a slappin' if I was trying to get to work on time.
pah! compared to the other hundreds of things that I could do in my car that would be much much worse, I dont feel too guilty by pulling out onto a clearway 10 minutes early. I have no respect for stonnington council or parking inspectors that patrol the area.. You're right, I did the wrong thing and I'll just cop it.. But I wont feel guilty. And I'll do it again. I have been for the last 5 years.. The problem is, EVERYONE pulls out onto the clearway at 8:50, so if I dont go at the same time, I lose my park for the day and then have to move my car every 2 hours. Parking in Prahran sucks. Does that mean I need to be spanked?? Cheers

Holding up peak hr traffic = BIG-TIME SLAP I think the below post falls under the category of "RANT". Please dont take this personally mr Jedi Its just that I get frustrated when stuck in traffic, and dont like when I get held up by people making it even worse.... VTD it if you want, but please read it first to see my point on this :>< Put your hand up if you believe that driving around in peak hour traffic is getting more and more difficult - ie. takes longer to get somewhere!Now how much more frustrating is it when you find the whole road is banked up, and nobody is going anywhere? You're waiting at the lights, they turn green, but you cant go through, cause the exit of the intersection is all choked up. Finally you get through, only to find that some nice person has stopped in a Clearway, and made everyone merge around them. I totaly agree with hating parking officers and money-hungry councils intent on booking people for overstaying their parking meter. Or for being in a taxi zone, 2 minutes after it turns into a taxi zone - with no taxis to be seen at all!
