Ok well tomorrow is my 21st, I just got an awesome new job (which i will need to have a licence for) starting in a week, and I just got done for speeding. So how can I get out of this? I am on my Ps until 22/11/05 so I have 4 points which will no doubt be gone with this fine (plus $700!!!), and I really need a licence for my new job. So I know I can take a 1 year good behaviour bond thing but I won't last on 1 point, is there a way to delay things for a month until I get my opens? If I took it to court would that help? Anyone with experience in this field who could offer an opinion it would be great! And yes, I do feel ashamed. :embarrassed:
Nope, date of your offence is what counts - you're shagged. Take it to court and you might get a worker's licence.
It looks like court is my only option, that will delay things for At least 6 weeks, and I might get a worker's licence... but the QLD transport website had this to say: "More than 40km/h over the speed limit: $A700 + 8 demerit points and 6 month suspension" So I guess that is minimum 6 months suspension, not even the chance at 12 months good behaviour, so it looks like I am up the creek. I hope like hell I can work something out for a workers permit, or else I might be unemployeed and walking.
Thanks! Last year I was in a car accident on my b'day, this year a massive ticket right before it, it would seem that driving on or around my b'day does not agree with me.
Take the one Point Firstly - Why on earth were you doing 117 in a 60 zone? anyway, I am sure you don't need to hear a lecture on this. The way it works is: Go on the 2 point for 12 month scheme and drive as carefully as is humanly possible (This allows you the luxury of one minor speeding offnce). Two thing will happen: A) You turn into a totally different driver, learn your ways and never get a speeding ticket again. B) About 6 months later you will probably lose this point O/T a hyundai excell with sports exhast and GT wing that keeps speeding up everytime you get to an O/T zone. Once you get the notice to loose your licence, take this to court. When you go in, you will need a letter from your employee to confirm that you are employed. The magistrate will then give you a slap on the wrist and return your licence (with all 12 points if you would have moved to your open licence). Beware - If you ever loose your licence again (espicially doing that speed) it is lekely that they will not give you a secound chance. They are very strict on hooning (And rightly so, residential streets are not race tracks but everyone makes mistakes  )
sounds well thought out! However I beleive being on my Ps i will only get 1 point for 12 months, and that is IF i get the option, i am pretty sure it is a minimum 6 month suspension, but I will soon find out, when I do I will assess the situation on its merits and try to keep my job. thanks for your input!
as for why... because I didn't realise there was a cop with a radar gun pointed at me Seriously though, it was a momentary lapse that has lasted for the past 4-5 months, I was heading for this for a long time, I think that getting done was a) only a matter of time & b) better than the alternative So all in all the best outcome I can hope for is that I will get out of this with a lesson learnt, and my job intact.
These things happen I only know this process as I went through the same thing a couple of years ago. Mine was a long list of minor incidents, but I was also on my P's when it happened (PM me for details if you want). Back then, they didn't have the auto licence disqualification. Just ring Queensland Transport tomorrow and ask if you get the option of the two point good behavior licence. If you do, the previously mentioned plan will work - otherwise skip the losing the good driver behaviour licence and go straight to the going to court bit. Good luck. I don't encourage speeding but I do like seeing people beat the system.
Well if you learnt your lesson then worthwhile. But your rooted regardless. Asking for a work license is your only option. If you can take the points. If you really have learnt your lesson then 12 months is deady easy not to lose a point. Im 10 years now and counting.
there is also the track that you can do those speeds and more >> legally, not saying i always behave on the roads buy do my excessive speeds on the track. maybe we should see more zeds on the track plus i need some more TT's to beat joking. sorry to hear anyways hope all goes well...
Tough...now if you lived in NSW, it's the date you pay your fine... but noooo...you decide to live in QLD...
Send a PM to "Neshy" explaining your situation He may be able to help with the legal side of things. As to my part in the "lecture" process... "Prevention is better than cure." Best of luck
Hope you get a good outcome but never do it again. I've never seen the road you drove that fast in but I cant imagine ever feeling comfortable at a speed like that in a 60 zone. 1 point should be easy when you consider the alternative. Unemployed and walking. You have a beautiful Zed. If anyone ever wants to race you in the future or you feel the urge to speed, just be content that you have nothing to prove as 1) You'd kick their arse anyway 2) Owning a Zed, you are already a winner!
If QLD is the same as VIC you have no choice for 1 or 2 point good behavior, you only get that if you accumulate too many points. Your licence will be suspended for 6 months unless you can get a workers licence. Also, because you only have 4 points left and will lose 8, when you come off your suspension you'll then have the choice to take another 3 month suspension or go on 12 months with no points and get one point back at the end.
In Queensland... Part 6A of the Transport Operations (Road Use Management - Driver Licensing) Regulation sets out the rules for 'Suspension for speeding more than 40km/h over the speed limit'. Section 30D allows for the person to appeal the suspension. Section 30D states that you can appeal the suspension if: 'The person may appeal against the suspension only on the grounds that the suspension would cause extreme hardship to the person, or the person's family, by depriving the person of the means of earning a living'. *Deep Breath* So Scotty if you're going to lose your job, I would say it's a great ground for you to appeal the suspension. Under subsection 6 of Section 30D, 'the court may dismiss an appeal if, considering the person's traffic history, the court considers it would be inappropriate to allow the appeal. How is your traffic history? Also, if you are interested in delaying things, subsection 8 provides that 'if the court dismisses an appeal, the person's licence is suspended from the date of the court's decision for that part of the suspension period that had not been served before the appeal was lodged'. The best thing to do I think Scott is to go ahead and appeal it, stating your work situation etc. That is, if you don't get the offer for the 12 month good behaviour period. If you do, I would definitely take it. Hope that helps! EDIT: section 25 talks about accumulation of demerit points and the good behaviour period
