I'd simply tell him your referring it to the police as you don't believe the box he is wanting to return is the box you sold him.

If he wants to pursue it further he can take you to court.

Based on that I wouldn't be offering to pay. Different story if he had contacted you as the problem arose. Personally I would consider providing a replacement fork as a gesture of good faith but I certainly wouldn't pay for the labour.

The box was sold as is and no refund should be made here nor cash should be handed from the seller to the buyer to compensate.

Buyer sounds dodgy as hell. It makes me sick to begin with. On another note I sold my TT Zed earlier this month. Sale went through, papers got signed and car was sold without RWC. Two days later I get a message saying the engine has blown and the fuel pump was gone with the buyer demanding his money back or some money for another motor. I had no idea what was done in those two days and the car ran perfectly fine in my possession and when test driven so I refused every request asking for money and I would of gone to the police if the harassment didn't stop. The buyer had no pressure to buy in the first place nor did he get it assessed by a professional certified mechanic. A few days later, I see it listed on Gumtree with no mention of a blown motor or any issue with the fuel pump.

Dorian I wouldn't hand over any money. The sale has already been completed and yes you have no idea what they have actually done to the box itself in those days.

As Dr Phil states, "No matter how flat you make a pancake, there is always two sides" :D

As others have alluded to, there is quite a few things to consider.

Have you had a chat to a gearbox shop to get their opinion on the likelyhood of the accident causing damage? (I don't believe for a second based on the photo you've shown that it would have. And even without the photo, for something INTERNAL to be "broken"...and nothing else noted wrong with the gearbox...no engine shifting...and so on...c'mon is he freakin' serious?). And still you did tell him about the accident anyway.

Are you sure he didn't mean the clutch fork?

Has he only verbally told you of what he thinks the problem is? Has he sent you a photo?

How many of his mates were "helping" him out with the refit/removal/dismantle inspection? Who knows what they did/didn't do!!!!

Based on what you've stated, I'd politely remind him of the issues that you told him about when he bought it, remind him he got it "cheaply", and then, ask him if he is a licenced mechanic, and why he dismantled the gearbox PRIOR to letting you know there was a problem. Also possibly, completely pass the buck - send him the reciept for rebuild and tell him to take it up with the gearbox repairer - I gaurantee he won't get very far.

Either way, I don't think he's got a leg to stand on, and you've got nothing further to answer to.

yes he sent me photos it is broken reverse fork
it wasnt in reverse when i crashed was in 3rd i know that 4 sure...
If by chance it was broken in crash would have had no prob fixing it but now its been split theres no way of ever knowing 1 things for sure i will be selling further zx stuff & i will be checking properly before & at point of sale so it doesnt happen again lesson 4 all here!!
really did cut my own throat with selling this box now im gunna have 2 pull 1 from one of my other cars to put in my project car damn sure its not been rebuilt and its gonna cost me more than $450 to rebuild one!!!!

Mate you've done nothing wrong. Don't pull your own box. If you supplied a warranty then yes you should but you haven't.
