Im sure most of you saw the pics of my damaged quarter panel on the zed. Now i find out the young girl has no insurance, no money, and her dad said they have no money either. Where do i go from here, ive got her drivers licence number. Do i report it to the cops.

Anyone gone through a similar situation

Ever hear of getting blood from a stone?

You could sue her and get 2 bucks a week?

Some things in life things are not fair, this is one of them.

Have you got comprehensive or 3rd party insurance yourself? Either way, check with your insurance company. Depending on your policy they may fix it and garnishee (take) money from her as she earns it to recover the costs.

"AAMI Third Party Property Damage Car Insurance covers you in the event your car is damaged by an uninsured motorist (up to $3,000 damage).
    " taken from AAMI website

    Good luck.

Sadly i was once in this situation, but on the other side of the accident. I had no insurance and sure as hell didn't have the 10k lying around to repair a brand new 4x4. So they had their insurance pay for it and i've been paying them on a monthly basis.

Going to court won't solve anything, a family friend got sued (a civil suit, nothing to do with cars or accidents) and they didn't have any money, so they have been paying off a 5k debt @ the rate of $20 per month. It won't get you anywhere, and you won't have the money to fix it anytime soon. I suggest you simply get your insurance to repair it.

Also. Yes. File a police report. Then it's on record for your insurance company. She can't deny the accident in 2 months from now too.

Rishwin is right. Court is actually the last resort. The legal system also makes your try concilliation and arbitration first. That's basically getting around a table and nutting out an agreement. The agreement is binding at the end of it. Prevents morons from going to court and suing over everything.

Should be illegal to not have 3rd party at a minimum.

Your insurance should cover it - supply them all the details, they will fix the car, and then they chase her for the money.

My sister had her car written off by an uninsured driver - even though she only had 3rd party, they paid out the full value of the car (was under their limit - I think $2500?)

i spoke to her dad again today, he has agreed to cover the cost of the materials for the repair.

Im thinking that this might be the best offer i can get, Im hapy to get something out of them instead of fck all

When I got rear ended by someone in Melb..I called Shannon's and explained what had happened, and gave them the contact details of the guy that ran into me...

I got the x3 quotes as Shannon's suggested, and then they chased him for the money..I guess they got it eventually..zed was repaired, I had no other issues (although this guy did agree to pay)

    Mate.

You could be selling yourself short here. How many times have I heard "I can't pay" in my business or from a driver who has scraped / hit my car? I've got the full amount of money every time. F#ckers try it on you know.

Lodge a police report, call your insurance and let 'em sort it out. Why should you have to pay for someone who didn't bother to pay for insurance themselves? You're subsidising their cheap arse lifestyle. That is definitely wrong.

I'm assuming you have insurance right?

Dude, seeing you know who did it. Just claim on your policy and let them chase it. Screw frigging around for the materials to fix your car. Not worth your time and effort.

If you can finger the at fault driver you wont do your no claim bonus.

But DO put in a Police report ASAP.

Sucks big time. Surgest to her father that she try's learning something about responsibilitys . If she is so smart and her parents are so ignorant to let her drive without insurance ( hell at least 3rd party ) perhaps she needs a lesson in life and she goes to a bank and gets a loan to pay for damage that she has caused. Yes you can't get blood out of a stone .But she is not a stone and bleed she can. A few years ago a young bloke unlicened , unisured and unregoed tried to say that to me after causing $18000 damage to a car my mrs. owned . Luckily we had full insurance but i tell you what, he soon understood that he was not a stone , i'm guessing he will never say that to anyone again and though i only got the excess of him i did get plenty of blood out of him and it felt great. When i was 18 my father sat me down and explained very clearly what the consequences would be if i got in a car unisured and all about being responsible for every action i take now that i'm an adult. Pitty other parents don't do the same thing. Although i don't comp insure the Z i have 3rd party and would never drive without .Hope you get it sorted in your favor and if you have comp at least they will fix it and you will have the smile on your face knowing that even if it's $5 a week for the rest of her life it might wipe the smile off her face. Hell tell her old man that if he's daughter wants to drive unisured it is him that is responsible for her actions and him that will pay one way or another. The buck always stops somewhere.

    It is illegal.
Many insurers (even 3rd party) will cover you in the case of a uninsurered driver. This is the best option, as then the insurance company then takes on the responsibility of money and you have no worries.

I'd definitely make the police report too, insurance will want it before they chase them for anything and it covers you if there are problems later.
