Now, today, you tell me in private mail that you are selling it to someone else for more that $170.00. I am not prepared to go into a Dutch Auction Sean. So I am accepting the fact that you have welched on the deal. I made an original offer of $100.00, you came back with $170.00 which I accepted, sight unseen and trusted you that the Wing was OK, and you then said you will pack it for freight and notify me of the cost of freight. Welching on a deal.... This sort of unacceptable behaviour seems to be increasing on the For Sale forums.:angry: What ever happened to the "Gentlemans Agreement"? People should realise that a verbal agreement can be considered as a "verbal contract" in a Court of Law, and in any case, welching on a deal is the surest way of making yourself VERY unpopular, and untrustworthy. Wake up Sean, maybe this explains why your employer "let you go". A man should be as good as his word.:thumbsdown:
Correction... ONO - OR NEAREST OFFER!!!! Yesterday i was offered $100 by Paul. I advised that the lowest i would go is $170 + Freight. I also suggested i check the freight cost out first as not to make this uneconomical for him and would get back to him. I advised that someone else has been interested and was due to be checking out the Wing before they offer to buy and if they do proceed with purchase would be able to pick it up. I made it quite clear to the other interested party that $175 had been offered and i was willing to sell at that price however i would wait until they had inspected before selling as they were in fact interested first. The other party was still interested and only after Paul and I's conversation last night arranged for a time to inspect. I then advised Paul that unless the other party offered more than the $175 the wing is 100% his. The term ONO means exactly that OR NEAREST OFFER. Paul - I also offered to reduce the price for you slightly as i did not want you feeling like you were being hard done by. CHILI - The reason my employer let me go is because business is quiet at the moment. I am in fact the only one left at the company besides the boss himself. I have been there the shortest term out of the other 5 people that were working there. (2 years) I am working only 1 day a week as the boss does not want and cannot afford to let me go completely. Many of our contractors refuse to work solely with the boss due to his attitude and he is aware of this. The work is seasonal and without me.. The work would be non existant. Suggest you find the facts before you go accusing people. Is it any wonder i want to get rid of my car and be done with this forum when we have forum members like you, Chili.:thumbsdown: That take shots at people without knowing the full story. THAT IS NOT ENTIRELY CORRECT Sean, and you know it. You made a deal with me and then you (the next day) cancelled it. You only made it known to me about another buyer after the deal was settled between us. All the people have to do is check the dates on this thread. I will not continue on this thread any longer. This quote says it all and doesn't leave room for misunderstandings. BTW Sean, when you say ONO, that indicates nearest offer UNDER the "asking price". If you reached a mutually acceptable price with Paul THAT becomes the "asking price". In the above quote from your post, it does seem that you reached an agreed price, otherwise why post that it has been sold to Paul? I don't have any animosity toward you Sean, just your apparent lack of ethics. I'm truly sorry that you lost your job, but in light of this thread, I think my comments are still valid (and afterall, I did say maybe.)

sold - maybe, maybe not ONO says to a buyer, "this is what I want, but I'll entertain offers below this, and you just may get lucky" So you make an offer to the seller, below that ONO amount, if it gets accepted UNCONDITIONALLY, it is a done deal. If THEN another person comes along with a higher offer, or even one at the original requested price, --- it is too late, the verbal contract has been accepted, deposit or no deposit. But it is not too late ---- if the additional amount is worth more that the seller's honesty --- This is what is called gazumpting, it may not be illegal, but it sure is seen as unethical in most of Australia's population. The job issue is totally moot, and true or untrue, is a personal slur by a third party that has nothing to do with the transaction [ just like me !!]. Fate posted the item sold, fate got it wrong by either not saying - "sold- provided no one offers me a better price" or "sold- provided this other dude does not want it" - it was just "sold - to the red baron" - not much room for debate there. I'm looking at buying another item, for a significant sum, and I have put in a firm offer and it has been accepted, but the offer to purchase was placed by me with the condition that I must be able to confirm a physical address for the seller prior to sending the money - that's a conditional sale. They should not entertain another offer until they have given me proof of their address - and I then renege [my bad]. If they cannot give me their physical address - then I can call the sale off. Thats the way it works. On a purely personal note, I also regularly troll through the forum, and I am sometimes surprised at the apparent continued good health of people who I assume actually hold food with the same hands that they type with, and then put that food in the same mouth that they speak with. Re: sold - maybe, maybe not i agree with you henpecked about the ONO stuff.. once your've said its sold and someone offers you a higher price too bad its been sold... -_-StRyDeR-_- once you have said sold..its means that its sold...even if you get a higher offer too bad I think a seller should put the price they want to sell it for up eg. $200 and thats the only thing they should accept...otherwise bump it down slowly...but once its sold its sold..
Fate is a friend of mine, but ... I'm not going to take sides. This looks like a case of miscommunication between a buyer and seller, they should sort it out between themselves. I don't really see the need for a third party to start speculating as to the reason one of the involved parties lost their job. Maybe we need a 'shit slinging' section on the forum so that people can get that sort of thing out of their system in an appropriate area.
