ZX vs Truck. (long)

    Friday morning i was happily putt putting along in the zed on the way to work, as you do. I happen to work in a very busy, truck infested part just on the outskirts of the city, near the big wholesale markets. Along the service lane, there are mainly transport and shipping companies all down this lane, with trucks going in and out of these driveways.
    I was sitting behind this truck (shipping container truck with a lift at the back) at the lights (no i wasn't too close behind him), and up ahead there is this truck turning from one driveway (further up) into another driveway closer to me (kind of like an illegal u turn). So this truck infront of me, chucks it into reverse, and slowly moves back so this guy can make it into the driveway. stupid time to do it really, theres a whole line of traffic behind me and theres not enough room for him to turn without entering onto the road.
    So the truck reverses. And gets closer. And closer. Start beeping crappy zed horn. And closer. Constant beeping. And bang. Smack bang onto the front of the zed.
    Scared me half to death, but not as much when i realise, he isnt in reverse any longer, hes heading off down the road without stopping. i grab the fone and dial the number written on the back of the lift and the guy on the other end of the line sends one of the managers down to me. We exhange numbers and this lady who was behind me (who i swear i was convinced i hit as well) rocks up and says i saw it all ect. this is the number and rego ect. The manager does his oh look at me im a hero stunt, and tells me to take it down to this panelbeater down the road. I do this later on, the guy has a look, writes up a quote, and says you'll hear from me soon.
    So i wait a few days, and call up the manager who tells me to speak to his boss. Basically, in a nutshell, he informs me that i made it all up, i could have done it the night before. I then inform him that no, i had people witness this. He tells me ''well you probably know her and pre-arranged this.'' Really not impressed with his attitude, i tell him i want to take the car to someone else. To which he replies ''i just offered to fix your car for you, why do you want to do that.'' Second opinion perhaps? ''Fine, you cant get it fixed until i find out how much it will cost.'' So i ask how much the quote was ''I'd prefer to keep that to myself for now, hopefully it will be less. I just find it hard to believe that a truck hit you and there is so little damage done to your car.'' Basically there are no scratches on my car, it was wet, and covered in dirt which may have helped it slide over the front of the car. And its not like he hit me at 60km. But that being said, i can barely get the bonnet closed, the lip on the front of the bonnet is mushed and missing paint. The top and bottom of nose panel is missing paint. Gapping between headlights and nose panel is all over the place. On my right hand light i can put my finger through the gap. Both lights are pushed in, the right one more considerably than the left.
    All because i'm a ''young lady'' who doesnt even know what way up the engine goes.Seriously though. I knew i should have overtaken that truck this morning :bash:

    the truck drivers are bigger than u so u must give way and most likely the driver is to

    Sorry to here about this, but technically, this is a hit and run, which, from my knowledge of the law, is a criminal offence. If the boss is defending the driver, then is he not guilty then, of aiding and abetting a criminal? Instead of ringing the number on the truck, you should have followed the driver of the truck, and spoken directly with him, in the presence of your witness.

    No doubt, some legal eagles on this forum will correct me if I'm wrong. Did he leave any paint marks, from the truck, on the front of your car???

    make sure they fix things asap...also kirby where do you work, is it near footscray???????....i had a garbo truck today decide to try and overtake me:confused: ( misses me but mybe half a meter) and then realises he cant make it and then he decides to get out of his truck at the next set of lights and come up to my window and starts screaming at me....i had to get out and explain (in a way that made him get back into his truck quickly)that he was in the wrong and he should p*ss off....but yeah sometimes they try and say what they can to get out of stupid situations...make sure they fix ur car especially before GOR:D

    In the event of a truck accident, both the driver and owner are held liable for damages/fines, etc. Go to the cops and take the witness/es you had and make a complaint/statement going into all the fine details.

    A lot of those industrial areas have security cameras running 24/7 so if your lucky, they might have caught something.

    Go back to Ground Zero and do some checking around.

    Definitely worth doing.

    Also, the police will be very interested in hearing about this. They tend to take it quite seriously when someone leaves the scene of an accident (any accident, no mater how minor) they were involved in without giving their details.

    yes ryan, i work right on footscray road :rolleyes: .

    unfortunately i didnt take down the witness' details or the guy on the bike that said i should have chased him down, but then they practically admitted fault when the manager guy rocked up so :rolleyes: .

    Thankfully it happened right out the front of a few places, so i might drop in out the and check it out with them. complaint to the cops sounds like a good idea too.

    First point of call in an incident like this should be the police, then your insurance company, and make sure you also get all the contact details of as many witnesses as possible. This removes the option for the driver / driver's company to shirk responsibility.

    Oh and sorry to hear about the damage, Kirby. Hopefully it will be sorted soon by the relevant parties (else we'll send the Karma police)

    :eek: :( :confused: you didnt get the info of the witnesses :( now its your word against the driver's.....your only hope now would be that the owner isnt an asshole and doesnt do a runner....or that there were some security cameras that were pointing near the incident.....hope it all works out

    This may not be too difficult to rectify. It happened on a service lane rather than a major road I gather? Most people going along there at that time of the day probably go the same way at about the same time most days. If you get stuck and really need to find them, go to work a bit earlier a few times and wait around there at about the same time and you will probably see them again.

    Inform tosser manager that hit and run is a CRIMINAL offense.
    Charges can be laid.

    You must always stop at the scene of an accident in which you are involved.
    And as the policeman oftens says, ignorance is no excuse of the law. Inform this manager you'll be laying charges in the civil court and seeking damages and then some. Is your neck sore from the impact???? ;)

    ahaha true greg...dont let him kn ow you dont have witnesses either....make sure he knows that you ahve names and mubers that you can call in oder to get verbal statesments....he will shit himself and wont throw you around...esspecially after he finds out that you will go to the police with witnesses....

    First thing i did

    After my recent truck accident, (sorry 2nd thing, first was to abuse the driver) was to take pictures of the truck buried in the back of my Zed.
    With pictures of the truck signage and number plate clearly visable.
    as Col says This removes the option for the driver / driver's company to shirk responsibility at a later date.
    Hope it all gets sorted in your favour.:biggrin:

    I had a truck side swipe my NA and after a few months i got the $$$ You just have to keep bugging them and get as much info as you can also take recors of whe you rang date/time and who you spoke to.

    I'm thinking of taking it to my panel beater and sending him the bill,, as we no his probably not going to pay up so it ends up going to the judge... then the fun begins..............

    sh*t that's some bad luck kirby. doesn't sound like they wanna do the right thing, hope everything get's sorted out or you get them sorted out. i'm guessing you're only on third party as well?
