What to do when a member wont come and pick up his car after its been worked on?

    Only other thing I can think of is to get it put in a storage facility and tell them the car is THERE at their cost. Then they can pay to get it out.

    Any other ideas MUNGY ?? I have been paid, NOW I just want it gone. Whats the going rate for storage?

    Could park it at the airport in short term parking :cool:

    What does the relevant law say? Can't you just sell it at some point, retain your costs then send him a cheque for what's left over? Send it to auction!

    Its been 6 months.

    Notify in writing that in 4 weeks it will be moved to 'x' storage yard. The cost will be incurred by them and cleared upon release.

    This just got a whole lot easier - stick it on a tow truck addressed to the owner and tell the tow company the owner will pay them at the other end :rofl:

    Seriously just send it over there, they either pay the tow company or suffer the consequences, inform the owner the job is done and you have arranged transportation. Storage is worth about $120 per week at least (here anyway), IF you feel like charging that then I'd say you are owed more than the car is worth possibly - but that's all a pain in the ass to deal with, just drive it over there and ditch it on his land or truck it, what ever puts it back in the owners possession then it's GONE! :D

    How far away do they live, you've got a towcar and trailer don't you?

    Might be simplest solution in the end if it's not too far.

    lol at the law , stuff that i had a guy not pick up his car the day after it was done so i pushed it down the road , people try and abuse it as free storage just take you fair share of money off it and push it out side .

    it must be nearly more than 180 days. car belongs to you soon, after you have notified the owner.

    Disposing of high value goods and vehicles


    The information below relates to:

    • goods worth $5000 or more
    • motor vehicles worth $1000 or more.
    If you are disposing of a high-value motor vehicle, you must obtain a written search result from the Personal Property Securities Register. There are penalties for failing to do this.
    Giving written notice

    Before you can take steps to dispose of any uncollected goods or vehicle, you must give written notice of your intention to dispose to:
    • the person who left the goods or vehicle with you
    • anyone who has registered an interest in the goods or vehicle on the Personal Property Securities Register
    • anyone else you are aware of who has (or claims to have) a proprietary or security interest in the goods or vehicle, and
    • the owner or registered operator of the goods or vehicle (if you know this is not the person who left the goods) ? see 'Details of motor vehicle?s registered operator' below.
    In the notice of your intention to dispose, you must include certain information - view our Written notice of intention to dispose page.
    Details of motor vehicle?s registered operator

    You can apply to VicRoads for a registered operator?s details, for a fee. Your application must be in the form of a statutory declaration, and must include:
    • your full name, address and date of birth (or your business name, address and ABN)
    • the vehicle?s last registration number (if available) and vehicle identification number
    • if you have given written notice of your intention to dispose of the vehicle to anyone, a copy of that notice
    • if you have applied to a court or the Victorian Civil and Administrative Tribunal (VCAT), a copy of the application, and
    • if you have obtained a search result from the Personal Property Securities Register, a copy of that search. You will have to provide this if you are applying for details of the registered operator of a high-value motor vehicle.
    Holding the goods or vehicle

    After giving written notice of your intention, you must retain the goods or vehicle for a further 28 days. You can then dispose of the goods or vehicle, unless the person who left them has collected them or given delivery instructions.
    If you cannot contact the person who left the goods or vehicle with you - despite making reasonable attempts to notify them in writing - you must wait 180 days. You may then take steps to dispose of the items or vehicle.
    Disposing of the goods

    You cannot keep high-value uncollected goods or vehicles for your own use. You can only dispose of them by public auction or private sale.
    If you sell the goods or vehicle at public auction, the auction must be advertised at least seven days in advance or held over a period of at least seven days (for example, an online auction).
    If you sell the goods or vehicle by private sale, you must:
    • given written notice to all of the people required
    • reasonably believe that the best price could only be achieved by private sale, and
    • take reasonable care to ensure that the goods are sold for the best price that can reasonably be obtained under the circumstances at the time of sale.
    You must record certain details about the goods or vehicle after disposal. For more information, view our Records of disposal page.
    Any money left over after you have sold the goods or vehicle, and paid the relevant charge and disposal costs, is ?unclaimed money?. You must handle it according to rules set by the Unclaimed Money Act 2008. For more information, visit the State Revenue Office website.
    If the sale does not cover the relevant charge and disposal costs, you may pursue owner or person who left the goods or vehicle for the debt in court.

    Selling an uncollected vehicle without a court order - Receipt

    When you sell any uncollected vehicle without a court order, you must give the buyer a receipt containing:
    • your full name, address and date of birth (or your business name, address and ABN)
    • the name of the vehicle?s registered owner
    • the vehicle?s last registration number (if available) and vehicle identification number
    • the buyer?s full name, address and date of birth
    • the date of sale
    • the sale price
    • a statement that the vehicle has been sold under Part 4.2 of the Australian Consumer Law and Fair Trading Act 2012.
    Both you and the buyer must sign the receipt.
    Penalties apply for failing to provide a signed receipt that complies with the above requirements.

    Written notice

    A written notice of your intention to dispose of uncollected goods or vehicles must include:
    • your name
    • a description of the goods or vehicle
    • an address at which the goods or vehicle may be collected
    • the relevant charge and, if this amount is likely to increase, an estimate of further charges that will apply - for more information about the relevant charge, view our Relevant charge page
    • a statement that you will dispose of the goods or vehicle on or after a specified date unless they are collected and the relevant charge paid, and
    • if applicable, a statement that you will retain the relevant charge and disposal costs from the proceeds of selling the goods or vehicle.
    You can give written notice:
    • in person, to the person who left the goods or vehicle, or
    • by delivering or posting it to their last known address.
    For someone with a publicly-registered interest in the goods or vehicle, you can send the written notice to their address as shown in the Personal Property Securities Register.

    Problem is I have never met the guy, The car was dropped off on a tow truck with no notes NOTHING.

    All I have is a mobile phone number and some forum posts.

    I dont even have an address for service of notices. I also understand he has moved.

    This is way too hard.

    I have his First name and phone number, That is all.

    LOL, I dont even know if he knows my address. As the tow truck driver who delivered it was a mate of mine. I imagine he just said, Can you drop it off at Grahams..................

    Talk to the Police and just treat it as being an abandoned vehicle on your property, the transaction for the work is complete, the job is done and you have been paid, beyond that point the car is abandoned IMO at least - the law might view it differently. At least see if they can provide you with the owners registered address etc. Privacy laws are a prick and might prevent you getting that info, we can still get it here in NZ but I don't know about Oz. Once you have addy just send the thing away - best of intentions etc, sorry my bad if it goes missing LOL!

    Easy, sell it cheap for cash, he can't find you so you're all good. :D

    PS take it to Phillip Island on saturday and give it a run for a laugh too.

    I am sure he does, But the guy has moved. I think to Hawthorn. Thats why it is still here. He has no where to park it.

    Any chance someone on the forum knows his full name?. Is car registered in his name ?. Google mobile number and car rego ?.

    LOL well I just sent another text. Saying I am starting preceedings to sell the car and that its accruing storage at $100 a week.

    Got a phone call in 5 minutes. Wants me to organize a Towtruck to his mums in Ferntree gully.

    Hopefully thats the end of it.
